Description

The subject of the contract is the successive delivery of diesel fuel Ekodiesel to the headquarters of the Customer in Zakopane at ul. Szymony 17a in accordance with the current demand of the Customer. The Ordering Party informs that the fuel (diesel oil) being the subject of this tender will be used by the Ordering Party exclusively for its own purposes for refuelling company cars. The Ordering Party informs that the fuel (diesel oil) being the subject of this proceeding will not be resold.2. the estimated expected quantity of diesel oil delivery to Ekodiesel in the period from the day of signing the agreement for a period of 12 months is 500 000 litres (option 300 000 litres).3. in accordance with the reservation in the option law the Ordering Party will surely make the purchase of diesel oil in the "guaranteed" quantity.4. the remaining quantities described as "option" will be realized depending on the actual needs of the Ordering Party, in accordance with the provision presented below concerning the exercise of the option right.5.LAW OF OPTION: a) The Contracting Authority, in accordance with clause 2 above, reserves the right to exercise the right of option depending on actual needs. b) If the Contracting Authority exercises the right of option: - The Economic Operator shall be obliged to apply the conditions and prices in accordance with the submitted offer, - The Economic Operator shall be entitled to additional remuneration, calculated in accordance with the rules described in the procedure.c) The right of option shall be exercised after the quantity guaranteed in the basic order has been exhausted without the need to notify the Economic Operator)The right of option shall be the right of the Contracting Authority, which may or may not be exercised within the framework of the performance of this agreement. If the Ordering Party does not exercise the right of option or partial use, the Contractor shall not be entitled to any claims on this account: Quality standards, referred to in Article 91(2a) of the PPL Act, relating to all material features of the subject matter of the contract are specified in the ToR and its appendices. The ToR describes the subject matter of the contract in a complete and exhaustive manner. The principles and quality standards concerning the quality of liquid fuels, including diesel oil, are contained in the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (Journal of Laws, item 1680). The quality of the supplied diesel oil Ekodiesel should meet the requirements of legal regulations, including the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (Annex 3 to the Regulation) or in force on the date of delivery of a given batch of diesel oil Ekodiesel.7A detailed description of the ORDER's PROVISIONAL DESCRIPTION CONCLUSIONS CONCLUSIVES THE SPECIFICATION OF THE IST CONDITIONS OF THE ORDER AVAILABLE AT THE CONTRACTOR'S BIP: https://tesko.bip.gov.pl8.Oferowana The price of 1 litre with a discount of diesel fuel shall include the price of diesel fuel together with the costs of transport to the Orderer's registered office.9 The Contractor shall ensure the Orderer continuity of deliveries of the subject matter of the ORDER during the term of the contract10. The payment will be made through a split payment mechanism, in accordance with Article 108a(1) of the VAT Act of 11 March 200412. The Economic Operators should acquaint themselves with due diligence with the contents of the tender documentation and obtain reliable information on the conditions and obligations that may in any way affect the value, nature of the offer or the performance of the contract: The procedure is conducted in accordance with the rules for the so-called "reverse procedure" referred to in Article 24a(1) and (2) of the PPL Act.
