Description

The subject matter of the contract is the supply of light heating oil L-1 - hereinafter referred to as "heating oil", for heating purposes, in accordance with the requirements of the Purchaser and its successive supply to the tanks of the Purchaser, in accordance with Annex 4 to the ToR - "Supply schedule".2 The Purchaser does not allow for the possibility of partial tenders.3Light heating oil L-1 must meet the quality standards specified in PN-C-96024:2011 (Petroleum products - heating oils) for the type L-1, which should be reflected in the form of a quality certificate (certificate) delivered for each delivery batch.4Light heating oil L-1 must comply with Polish standards and the Regulation of the Minister of Economy of 9.10.2015 on quality requirements for liquid fuels (Journal of Laws of 2015, item 1680), Regulation of the Minister of Energy of 1.3.2017 on methods of testing the quality of light heating oil, heavy heating oil and oil for engines of inland waterway vessels (Journal of Laws of 2017), The delivery lot is understood as a single delivery of heating oil of one type and grade delivered to the recipient by tank truck, identified with a transport document (e.g. proof of filling, proof of issue / attestation) and a quality certificate (certificate).6The quantity of fuel oil supplied should be invoiced in accordance with the volume fuel sales system based on m3 at a reference temperature of 15oC.7. The Contractor is responsible for the quality of the fuel oil supplied.8. Minimum parameters to be met by light fuel oil:8.1. 42,6 MJ/kg;8.2. density at 15oC max. 860 kg/m3;8.3. flash point above 56oC;8.4. kinematic viscosity at 20oC max. 6,00 mm2/s;8.5. sulphur content max. 0,1 % (m/m).9. Prior to the commencement of deliveries, the Contractor shall make working organisational and technical arrangements with the customer concerning the manner of receiving the delivery lot, including: checking the possibility of advising the customer on deliveries of fuel oil lots to the customer, sealing those lots and sample seals.10Heating oil should be delivered in tank trucks in accordance with the requirements of the PN-91/C-04024 standard, equipped with filling tips with legalised "metering unit" in units of measurement - litre. Deliveries must be carried out with specialized tankers equipped with dispensing devices with important legalization features - pumps and printers - indicating the exact amount of fuel oil delivered at the actual and reference temperature of +15oC (dispensing devices should also have legalization certificates issued by the Office of Weights and Measures).11. Fuel oil will be delivered in compliance with all applicable regulations governing the transport of hazardous materials according to RID/ADR.12. Fuel oil will be delivered with tanks at the Contractor's expense. The price of transport and filling of the Customer's tanks is included in the unit price of 1 litre of heating oil. The price of 1 litre of heating oil delivered within the scope of the order will depend on the indexation of unit prices specified in § 3 of the Material Provisions of the Agreement, being Annex 3 to the ToR.13. The supply of heating oil will be carried out successively (in batches) from 7:30 a.m. to 1:00 p.m. on business days, based on the demand submitted by the Ordering Party via e-mail, fax or telephone.14The Contractor is obliged to deliver the fuel within no more than 2 working days from the day of placing the demand by the Purchaser.15 The Purchaser reserves the right to limit the subject of the contract during the term of the contract for reasons beyond the control of the Purchaser and to order smaller quantities of heating oil than those specified in Annex 4 to the ToR - "Delivery schedule". (total reduction may not exceed 40 % of the initial quantity).
