Description

The subject of the contract is forest management services as defined in Art. 6.1.1. 1 of the Forest Act of 28 September 1991 (uniform text: Journal of Laws of 2020, item 1463, as amended). - hereinafter: "Forest Act") covering the works in the field of silviculture and forest protection, fire protection, logging and skidding as well as drainage and meadow and agricultural management, to be performed in the area of Kolbuszowa Forest Inspectorate in 2021 - 2022.
Performance of services in the field of forest management, logging and skidding, melioration and meadow and agricultural management in the Poręby Dymarskie Forest Inspectorate3.1. 1 of the Act of 28 September 1991 on forests (uniform text: Journal of Laws of 2020, item 1463, as amended). - hereinafter: "Forest Act") covering the works on silviculture and forest protection, fire protection, logging and skidding as well as drainage and meadow and agricultural management, to be performed in the area of Kolbuszowa Forest Inspectorate in 2021 - 2022.2) The material scope of the subject matter of the contract covers the total amount of works in the field of silviculture and forest protection, fire protection, logging and skidding as well as drainage and meadow and agricultural management resulting from Annex No. 3 to the ToR, which consists of: - Annex No. 3.1. - size of works according to groups of activities,- Annex No. 3.2. - Annex No. 3.3. - List of difficulty levels and difficulty coefficients, as well as skidding zones and distances, - Annex No. 3.4. - List of items not available for machine harvesting, - Annex No. 3.5. - Information on the application of possible harvesting technologies.3) The material ranges listed in Annexes No. 3.1. - 3.3. and 3.5. are estimated.4. The quality standards relating to all significant features of the subject matter of the contract are specified in Decision No. 100 of the Director of the Regional Directorate of State Forests of 18.08.2020 on the introduction of the Description of the Forest Performance Technology Standard. The description of the Forest Work Performance Technology standard (activities) included in the subject matter of the contract, specified in this decision, is included in Annex No. 4 to the ToR.5) Descriptions of activity codes describing individual works (activities) included in the subject matter of the contract are described in Annex No. 4 to the ToR.6) Description of the principles of the procedure for acceptance of works is included in Annex No. 5 to the ToR.7) The subject matter of the contract is divided into 8 parts: (hereinafter also referred to as "Packages") "The Contracting Authority accepts partial bids. A Economic Operator may submit a tender for one or more Part-Packages. The offer submitted for a given Part - Package must, however, cover the entire scope of works provided for in the ToR for this Part - Package. Offers that do not include the full scope of the subject matter of the contract specified in the partial task shall be rejected.8) The place of execution of the subject matter of the contract shall be the administrative area of the Kolbuszowa Forest Inspectorate. 9) The execution of works included in the subject matter of the contract for particular Packages shall take place in the area of forests - appropriate for a given Package ("Package Execution Area"). The location (forest address) of particular forest works included in the subject matter of the Contract is preliminary. The location (forest address) of particular works within the scope of the subject matter of the Agreement will be specified in the Order referred to in point 3.3.1), with the reservation that it will always be the Package Implementation Area. Borders of the administrative area of the Kolbuszowa Forest Inspectorate, forest districts appropriate for a given part of the Order and forest deforestation are available on the website: https://www.bdl.lasy.gov.pl/portal/mapy10) The provisions of points 7 and 9 do not affect the Contracting Authority's rights resulting from the model contract on public procurement (Annex 10 to the ToR).11) Due to the actual natural and weather situation that may occur during the execution of the subject matter of the contract, as well as the currently unforeseen economic and economic situation, the Contracting Authority reserves the right to make reducing adjustments, increasing adjustments, determining new locations, as well as stopping the activities indicated in individual lines. cont. in item II.2.11. U. of 2006 No 58, item 405 as amended),- Regulation of the Minister of Internal Affairs and Administration of 7 June 2010 on fire protection of buildings, other buildings and areas (Dz. U. of 2010 No 109, item 719 as amended),- Regulation of the Minister of Agriculture and Rural Development of 18 December 2013 on requirements concerning technical efficiency of equipment intended for the use of plant protection products (uniform text: Dz. U. of 2016, item 760),- Regulation of the Minister of Agriculture and Rural Development of 13 December 2013. on confirming technical efficiency of equipment intended for the application of plant protection products (uniform text: Dz. U. 2016, item 924, as amended),- Regulation of the Council of Ministers of 1 July 2009 on determining the circumstances and causes of accidents at work (Dz. U. of 2009 No. 105, item 870),- Regulation of the Minister of Environment of 18 December 2017 on the requirements of good practice in forest management (Dz. Performance of services in the field of forest management, logging and skidding, meadow and agricultural management in Leśnictwo Nowa WieśCd. from point II.2.14: ...and subject of the Order covered by partial acceptance. The quantity of raw material to be executed within the framework of logging and skidding indicated in the Order is an estimated value. The execution of the Order with respect to a given location is the execution of the procedure specified in the Order at that location. It is considered that the completion of the logging and skidding order will be completed once the Contractor has completed all the work and fulfilled all requirements described in the ToR. An inseparable appendix to the logging and skidding work order is a situational sketch of the work area with marked protection facilities and the organisation of work. The Contractor shall be obliged to confirm and receive a copy of the sketch, in particular to protect the indicated objects on the work area.2) The Contractor may not refuse to accept the Order, which does not violate the provisions of item 3.3.1)3)3) Immediately after submitting the Order to the Contractor, the Contractor shall inform the Ordering Party about any obstacles known to it which prevent or hinder execution of the Order.4) Information on the issuance of the Order shall be provided to the Contractor, according to the Ordering Party's choice, by telephone (also SMS), e-mail or fax, then the Ordering Party shall immediately transmit the Order in writing, and the Contractor shall each time confirm the acceptance of the Order by signing it.5) The work order shall at the same time constitute a protocol of transfer of area. From the moment the area is transferred, the Contractor shall be liable for damages caused to the Awarding Entity and third parties on the transferred area.6) The calls to accept the Order shall be made at least 1 day in advance.7) Without transferring the Order, pursuant to the preceding paragraphs, the Contractor is not entitled to perform any works covered by the subject matter of the Agreement, subject to paragraph 3.3.1)8).8) In the case of the need to immediately order works, the Awarding Entity's representative may transfer the Order by telephone. An Order submitted by telephone shall be immediately confirmed in the manner referred to in item 3.3.1)4).9) It is permitted to modify an Order after its submission, if special circumstances occur. The Awarding Entity is entitled to change the location of execution of the subject of the Order, suspend execution or cancel the execution of the Order in the event of unfavourable natural or weather conditions, changes on the wood sales market or entrusting the Awarding Entity with new economic or public tasks. The Order for harvesting does not need to be modified, if the anticipated actual execution of the harvest by the Contractor falls within the scope of +/- 20% of the estimated value referred to in item 1).1), and the Contractor shall execute all the works and fulfil all the requirements described in ToR.10) The quantitative and qualitative acceptance of the subject matter of the agreement shall cover the actual size of the works executed on the basis of the Order and shall be made by the territorially competent foresters (subforesters) on the printout of the Work Acceptance Protocol. The acceptance report is the basis for issuing an invoice for the service performed by the Contractor.11) Acceptance of the work area from the Contractor after the logging and skidding works are performed shall take place at the moment of preparing the Item Return Report. In the case of destruction of protection facilities, damage to trees above the accepted standard, soil damage, damage to skidding trails, damage to roads, culverts, foresters (foresters) shall submit information to the Chief Forester in order to initiate the procedure of imposing contractual penalties on the Contractor.12) Settlements shall be made for the services actually rendered, according to unit rates given by the Contractor in the offer estimate on the basis of the acceptance protocol completed... cont. in point II.2.11. Performance of services in the field of forest management, logging and skidding, meadow and agricultural management in the Wilcza Wola Forest District. in point II.1.4: ...forehead for oil and fuel absorbing mats).8) During the execution of the subject matter of the contract, the Economic Operator is obliged to mark the entry ban in accordance with Article 26 of the Forest Act. In particular, the Economic Operator shall be obliged to properly mark with warning signs the areas on which the works including harvesting, logging and shredding of logging residues and other works provided for in the instruction specified in item II.1.4. 3.2. 2)Forest roads, public roads, hiking trails (especially bicycle, walking, horse and water routes) and other communication facilities running through the work area shall be closed to third parties, including public traffic, for the period from the start of the works on the position to its return. Signs prohibiting access to the forest shall be placed near roads, trails and traffic facilities, not closer than 100 m from the border of the position where the work is carried out. The prohibition signs shall be visible. Purchase of boards is the responsibility of the Purchaser. Location of the boards before the commencement of work requires agreement with an authorised representative of the Contracting Authority.3.4. A contractor may entrust the execution of elements (parts) of the contract subject to subcontractors. If a contractor intends to execute the subject matter of the contract with the participation of subcontractors, it shall be obliged to indicate in its tender: the part(s) of the contract (material scope) that it intends to entrust to subcontractors and the name of the subcontractors' companies. Such indication shall be included in the Tender. If no subcontracting is indicated in the tender, the contractor will only be allowed to introduce a subcontractor under the conditions specified in the contract.3The Contracting Authority shall require that a contractor or a subcontractor employ, on the basis of a contract of employment, persons performing the activities included in the subject matter of the contract consisting in the acquisition and harvesting of wood (saws, tractor drivers), and in a forest nursery all the employees demonstrated by the Contractor to meet the condition of participation in the proceedings as regards the persons assigned to perform the subject matter of the contract, if the performance of these activities consists in performing work in the manner specified in article 22 § 1 of the Act of 26 June 1974. - Labour Code (uniform text: Journal of Laws of 2020, item 1320, as amended). Obligation to conclude a contract with employees employed in nursery care - Part 8 of the contract shall be binding for the Contractor from 1 March to 30 September of each year of contract duration.2 At each request of the Contracting Authority, the Contractor shall be obliged to present evidence of continuity of employment relationship for employees specified in item 1 in the form of anonymized (only the name of the employee) copies of personal monthly reports on contributions due and benefits paid, which are confirmation of payment of contributions for employees.3.6 In relation to each Package the Ordering Party is entitled to order additional material scope covering the same (analogous) activities as described in the description of the subject matter of the contract ("Option"). The subject matter of the Option will be works analogous to those described in the ToR (and priced by the Economic Operator in the offer cost estimate which is a part of the Offer). As part of the Option, at the choice of the Contracting Authority, all, some or one of the works indicated in the ToR (and priced by the Economic Operator in the cost estimate constituting a part of the Offer) may be ordered. The Contracting Authority is not obliged to order the works covered by the subject matter of the Option, and the Contractor shall not be entitled to claim them. Works being the subject of the Option may be ordered in the amount equivalent to 20% of the value of the subject of the contract defined in accordance with § 10.1 of the specimen agreement constituting Annex 12 to the ToR.
