Description

The subject matter of the contract are forest management services as defined in Article 6.1.1 of the Forest Act of 28 September 1991 (uniform text: Dz. 1 of the Forest Act of 28 September 1991 (consolidated text: Journal of Laws of 2021, item 1275, as amended - "the Forest Act") covering silviculture and forest protection, fire protection, timber harvesting and skidding, as well as nursery management works to be performed in the Bielsko Forest District and the forest nursery GNS Zapora in the year 2022.The material scope of the order covers the total amount of works in the field of silviculture and forest protection, fire protection, harvesting and skidding of wood and nursery management in accordance with appendix no 3 to the SWZ. The descriptions of the activity codes describing the individual forest works (activities) included in the order subject have been included in appendix no 4 to the SWZ.
The subject of the contract are forest management services as defined in art. 6 section 1 point 1 of the Act of 28 September 1991. 1 of the Forest Act of 28 September 1991 (unified text: Journal of Laws of 2021, item 1275, as amended - "Forest Act") covering breeding and forest protection, fire protection, harvesting and skidding. The subject matter of the contract covers the total amount of silviculture and forest protection, fire protection, harvesting and skidding works in accordance with appendix no 3 to the SWZ, which consists of Annex No. 3.1.size of work by activity group and location; Annex No. 3.2.sorting arrangement of timber harvesting;Annex No. 3.3.summary of distances and conditions of timber skidding;Annex No. 3.4.summary of items not available for machine harvesting;Annex No. 3.5.information on use of possible harvesting technologies The material scopes summarized in Annexes No. 3.1.,3.3. and 3.5. are estimates. Descriptions of activity codes describing particular forestry works (activities) included in the subject matter of the contract and rules of procedures for forestry works acceptance are described in Annex 4 to the SWZ. Increasing corrections do not mean introducing new works not included in the scope of order, and decreasing corrections do not mean resigning from some of the works altogether. They should be understood as an increase in the number of works in one location (forest address) in the Package Execution Area (including locations in the Package Execution Area not initially indicated in the SWZ), with a simultaneous decrease in the number of works in another location (forest address) in the Package Execution Area, within the total quantities of individual works included in the scope of the Subject of the Agreement specified in the SWZ, to be performed in the entire Package Execution Area. The necessity to increase the size of certain elements of the contract during its performance may also arise in order to complete the full scope of works described in the subject of the contract. The Contracting Authority shall allow the Contracting Party to change the harvesting technology in particularly justified cases, e.g. change of conditions for which the above mentioned activities were established. The justification shall be presented to the Contractor in each case. The Contractor shall perform the subject of the contract based on written orders submitted by the Ordering Party's Representatives ("Order"). The content of the Order is defined in the public procurement contract (Appendix no. 12 to the SWZ). The Contractor will be obliged to use biodegradable oil to lubricate cutting systems in operating chainsaws and cutting heads, machinery and equipment, and oil absorption sets in equipment operated in forest areas. The material scope of the subject of the contract includes the total amount of works in the area of nursery management resulting from appendix no 3 to SWZ (SWZ) which consists of: Appendix No. 3.1.size of works by groups of activities and locations. The material ranges presented in appendix no 3.1.are estimates. Descriptions of activity codes describing particular works (activities) included in the subject matter of the contract as well as rules of procedures for works acceptance were described in appendix no 4 to SWZ (Terms of Reference). Due to the actual natural and weather conditions that may occur during the execution of the subject matter of the contract as well as unforeseeable at the moment economic situation, the Contracting Authority reserves the right to make decreasing adjustments, increasing adjustments, setting new locations as well as suspending execution of activities indicated in particular rows of tables describing the subject matter of the contract. Increasing corrections do not mean introducing new works not included in the scope of order, and decreasing corrections do not mean resigning from some of the works altogether. They should be understood as an increase in the number of works in one group of activities with a simultaneous decrease in the number of works in another group of activities within the total number of individual works included in the scope of the Subject of the Contract specified in the SWZ, to be performed in the whole Package Execution Area. The necessity to increase the size of some elements of the contract during its performance may also occur in order to perform the full scope of works described in the subject of the contract. The Contractor shall perform the subject matter of the contract based on written orders submitted by the Ordering Party's Representatives ("Order"). The content of the Order is defined in the public procurement contract (Appendix no. 12 to the SWZ). The Contractor will be obliged to use biodegradable oil to lubricate cutting systems in operating chainsaws and cutting heads, machinery and equipment, and oil absorption sets in equipment operated in forest areas. Pursuant to Article 95 of the Polish Public Procurement Law, it is required that the Contractor or its subcontractor hire, on the basis of an employment relationship, people performing activities related to the contract execution
