Description

The subject matter of the present proceedings is "Development and updating of documents on the climate policy of the City of Lodz within the framework of the Lodz Climate Package". A detailed description of the subject matter of the contract is included in Annex No. 1 to the SWZ. The Ordering Party shall demand from the Contractor a contribution in the amount of: PLN 60,000.00 (in words: sixty thousand zlotys 00/100).
Pursuant to Article 95 of the PPL Act, the Contracting Authority requires employment by the Contractor or Subcontractor on the basis of an employment contract of persons performing the activities indicated by the Contracting Authority in the execution of the contract, if the performance of these activities involves the performance of work as specified in Article 22 §1 of the Act of June 26, 1974. - Labor Code (Journal of Laws of 2019, item 1040, as amended), i.e., the Project Manager with respect to: - coordination and management of the implementation of the entire subject of the contract on the part of the contractor, - contact with the contracting authority on matters relevant to the implementation of the contract, including in particular the contract implementation schedule, guidelines, directional decisions and acceptance of the contract scope. The scope of work of the person performing the contract execution activities indicated by the Contracting Authority, as well as the manner of documenting the employment of such persons and the powers of the Contracting Authority to control the Contractor's compliance with the requirements in question and to impose sanctions for non-compliance with them, are specified in the Description of the Subject of the Order, which constitutes Appendix No. 1 to the SWZ, and in the model contract, which constitutes Appendix No. 7 to the SWZ. The contract completion date - November 30, 2023 is the contract completion date related to the end of the fiscal year in which the contracting authority has the funds:1) Stage 1 - SECAP and Environmental Protection Program - update - within 4 months from the date of signing the contract;2) Stage 2 - Main Report, carbon footprint calculation, Municipal Adaptation Plan, Lodz Greening Strategy within 8 months from the date of signing the contract.3) The Contractor undertakes to provide the consulting services specified in § 2 (2) of the Contract until November 30, 2023.The Contractor is excluded from the procurement proceedings on the grounds contained in Article 108 (1) of the Public Procurement Law.In connection with Article 5k of Council Regulation (EU) 2022/576 of April 8, 2022 amending Regulation (EU) No. 833/2014 concerning restrictive measures in connection with Russia's actions destabilizing the situation in Ukraine and pursuant to Art. 7 (1) of the Law of April 13, 2022 on special solutions to prevent support for aggression against Ukraine and to protect national security (i.e., Journal of Laws of 2022, item 835) from the public procurement proceedings conducted under the Law of September 11, 2019. - The Public Procurement Law excludes Contractors. The Contracting Authority does not provide for exclusion of the Contractor on the basis of Article 109 (1) of the PPL Act. If in relation to the Contractor there are grounds for exclusion specified in item 7.1 of the PPL, the Contractor will be excluded on the basis of Article 111 of the PPL Act.The Contractor is not subject to exclusion in the circumstances specified in Article 108 (1) points 1, 2, 5, if he proves to the Contracting Authority that he has jointly fulfilled the requirements specified in Article 110 (2) points 1-3 of the PPL Act. The Economic Operator may, in order to prove that he meets the conditions for participation in the proceeding, in appropriate situations and with regard to a specific contract or part thereof, rely on the technical or professional abilities or financial or economic situation of entities making available the resources, regardless of the legal nature of the relationship between them.Pursuant to Article 139 (1) of the PPL Act, the Contracting Authority will first examine and evaluate tenders and then qualify the entity of the Economic Operator whose tender was rated highest in terms of lack of grounds for exclusion and meeting the conditions for participation in the proceeding. Along with the bid, the Contractor is obliged to submit, for preliminary confirmation that he is not subject to exclusion and meets the conditions for participation in the procedure: 1. a statement, current as of the date of submission of tenders, regarding lack of grounds for exclusion from the procedure and fulfillment of the conditions for participation in the procedure in the form of a Single European Procurement Document (JEDZ/ESPD) , 2Certification of the Contractor regarding the grounds for exclusion under Article 5k and Article 7 (...
