Description

The subject matter of the contract is a service of designing, development and furnishing of an exhibition stand with an area of 61.29 sq m for the international investment fair MIPIM 2022 which will be held in Cannes, France, on March 15-18, 2022. 2. A detailed description of the subject matter of the contract has been specified in the Terms of Reference (Annex 1 to the ToR) and in the model contract (Annex 2 to the ToR).3 The Ordering Party requires that the stand meets the requirements in terms of accessibility for people with disabilities and is designed for all users.4 The Ordering Party does not allow for partial bids. The Ordering Party does not allow for bidding in parts. The construction of the stand, due to the coherence of the concept and coordination of activities related to its assembly, must be carried out by one contractor for economic and organisational reasons.
A. not be subject to exclusion pursuant to provisions of Art. 108 (1) of the PPL Act, whereunder a contractor shall be excluded from the procurement proceedings a) participation in an organised criminal group or in an association with the aim of committing a criminal or fiscal offence, referred to in art. 258 of the Penal Code,b) trafficking in human beings, referred to in art. 189a of the Penal Code,c) referred to in art. 228-230a, art. 250a of the Penal Code or in art. 46 or art. 48 of the Act on Sport of 25 June 2010,d) financing of a terrorist offence, referred to in art. 299 of the Penal Code,e) of a terrorist nature, referred to in Art. 115 § 20 of the Penal Code, or aiming at committing this offence,f) entrusting work to a minor foreigner, referred to in Art. 9.2 of the Act of 15 June 2012 on the results of employing foreigners unlawfully residing on the territory of the Republic of Poland (Dz. U. No. 769),g) an offence against economic turnover referred to in Article 296-307 of the Penal Code, an offence against fraud referred to in Article 286 of the Penal Code, an offence against credibility of documents referred to in Article 270-277d of the Penal Code or a fiscal offence,h) referred to in Article 9 sections 1 and 3 or Article 10 of the Act of 15 June 2012 2) if the incumbent member of its managing or supervisory body, a partner in a general partnership or partnership, a general partner in a limited partnership or a limited joint-stock partnership, or a proxy has been validly convicted of an offence referred to in item 1;3) against whom a final court judgement or a final administrative decision on default of payment of taxes, fees or contributions for social or health insurance was issued, unless the economic operator, respectively before the deadline for submission of requests to participate in the proceedings or before the deadline for submission of tenders, made the payment of due taxes, fees or contributions for social or health insurance together with interest or fines or concluded a binding agreement on payment of these receivables;5) if the contracting authority can confirm, based on reliable reasons, that the economic operator entered into an agreement with other economic operators in order to distort competition, particularly if they belong to the same group as the one referred to in the Act of 16 February 2007. 6) if, in the cases referred to in art. 85 sec. 1, there has been a distortion of competition resulting from previous involvement of that economic operator or an entity which belongs to the same capital group with the economic operator within the meaning of the act of 16 February 2007. on competition and consumer protection unless the distortion of competition caused by such action can be eliminated otherwise than by excluding the Economic Operator from participation in the procurement procedure, and the Economic Operator shall be excluded pursuant to provisions of Articles 110 and 111 of the PPL Act, as far as these provisions refer to obligatory exclusion grounds.B. they fulfill the conditions of participation in the procedure
