Description

The Contractor shall provide a guarantee and warranty for defects in the completed order for a minimum of 3 years. The subject matter and scope of the study and the requirements for the performance of the contract have been included in the detailed description of the subject matter of the contract - Chapter IV of the ToR. The Awarding Entity requires that the subject matter of the contract be performed in accordance with the tender and the ToR, in particular: a) the table of design studies; b) detailed description of the subject matter of the contract; c) important provisions of the agreement.
If necessary, the Economic Operator shall provide: a) authors of designs for a given industry: having appropriate authorizations to develop design documentation for a given industry; b) reviewers of industry designs: having appropriate authorizations to verify design documentation for a given industry; c) surveyor: a) authors of individual industry projects: duly authorized to verify design documentation of a given industry; b) verifying industry projects: duly authorized to verify design documentation of a given industry; c) surveyor: duly authorized to verify design documentation of a given industry; d) unit/person carrying out geotechnical and geological surveys, road structures and objects; e) unit/person preparing water and legal operations, environmental impact reports (including natural inventories).Whenever the description of the conditions of participation in the proceedings refers to the rights, in the case of persons who are citizens of the European Union member states this means a decision on the recognition of the required qualifications to perform independent technical functions in the construction industry in the Republic of Poland within the scope of the subject matter of this contract - in accordance with the relevant regulations, in particular the Act of 18 March 2008. on the principles of recognition of professional qualifications acquired in the Member States of the European Union (Journal of Laws of 2008 No. 63, item 394) and the Act of 15 December 2000 on professional self-governments of architects, civil engineers and urban planners (Journal of Laws of 2001 No. 5, item 42, as amended).The Contracting Authority shall require that the Contractor or subcontractor employ persons performing the activities specified in the detailed description of the subject matter of the contract, except for persons performing independent technical functions in the construction industry and persons performing activities related to the performance of surveying works, environmental protection studies, works related to the preparation of materials for administrative decisions and measurement works for telecommunication, power, gas, water and lighting networks and equipment. In order to document the employment of the persons referred to in art. 29 item 3a of the Act, the Economic Operator should declare in the tender form that the persons performing the above mentioned activities within the scope of the contract will be employed on the basis of an employment contract. The Contracting Authority has the right to inspect the Economic Operator within the scope of employment of the persons referred to in art. 29 item 3a of the Act by calling upon him in writing to provide information within 14 days from receiving such a call.
