The subject of the contract is the purchase of training phantoms for the needs of the project tasks: "Cardiological rehabilitation as an opportunity to extend the professional activity of the inhabitants of the Pomorskie Voivodeship". (CPV: 35112100-3 Emergency exercise dummies). A detailed description of the subject matter of the contract specifying the Contracting Authority's requirements and quantities is included in Annex 1B to the ToR - Description of the subject matter of the contract (called OPZ), which the Economic Operator attaches to the tender. By filling in the indicated items, the Economic Operator confirms that he meets the requirements specified by the Awarding Entity.
The subject matter of the contract is the purchase of training phantoms for the purposes of performing tasks within the project: "Cardiological rehabilitation as an opportunity to extend the professional activity of the inhabitants of Pomorskie Voivodeship". A detailed description of the subject matter of the contract specifying the Contracting Authority's requirements and quantities is included in Annex 1B to the ToR - Description of the subject matter of the contract (called OPZ), which the Economic Operator attaches to the tender. The subject matter of the contract offered must be brand new, complete, of a high standard both in terms of quality and functionality, as well as free from defects in materials, construction and legal regulations.4.The subject matter of the order must comply with the Act of 20 May 2010 on Medical Devices (i.e. Journal of Laws of 2019, item 175, as amended).6. The Contractor shall be obliged to deliver on the date of delivery of the subject matter of the order and, at the request of the Purchaser, copies of documents confirmed to be true to the original, which indicate that the offered assortment has been approved for marketing and use in accordance with the applicable law.7The detailed scope of the subject matter of the contract and the manner of its performance have been specified in the following appendices to the ToR:- Annex 1A - Tender Form (FO),- Annex 1B - Description of the subject matter of the contract (OPZ),- Annex 6 - Draft contract.8 In the case of assortment specified by means of indicating a trademark, patent or origin, source or a specific process which characterizes products supplied by a particular Economic Operator, the Contracting Authority shall allow for submission of equivalent bids provided that the proposed solutions have technical, quality, technological parameters, etc. not worse than those presented in the description of the subject matter of the contract. The Economic Operator who invokes equivalent solutions is obliged to prove that the supplies he offers meet the requirements specified by the Awarding Entity.9 In the case of the description of the subject matter of the contract (appendix 1B to the ToR) by reference to standards, European technical evaluations, approvals, technical specifications and technical reference systems referred to in art. 30 par. 1 item 2 and par. 3 of the PPL Act, the Awarding Entity shall allow offering equivalent solutions to the one described, provided that they ensure that the technical parameters are not worse than those required by the Awarding Entity in the tender documentation. Pursuant to Article 30(5) of the PPL Act, the Economic Operator who invokes solutions equivalent to the described one is obliged to prove that the supplies he offers meet the requirements specified by the Contracting Authority. In such a situation, the Contracting Authority requires submission of relevant documents to substantiate these solutions. The Contracting Authority shall indicate that the description of the equivalent solution should be sufficiently detailed to enable the Contracting Authority, when evaluating a tender, to verify compliance with the requirements concerning its technical parameters and to determine whether the proposed solution is equivalent.10 The method of implementation of the subject matter of the contract is specified in the draft contract included in Annex 6 to the ToR.11 The contract, refers to a project/programme financed by the European Union under the Regional Operational Programme of Pomorskie Voivodeship for 2014-2020, Measure 05.04 Health on the labour market.
