Description

The subject of the contract is the supply of electricity for the period from 01.01.2021 to 31.12.2021 to 307 points of consumption (PPE) with a total estimated volume (+/- 10%) of 9 280.91 MWh, of which:1) For premises and facilities (Lot 1 of the contract) - 5 173.59 MWh - the detailed list of PPE is attached as Annex 1a to the ToR, 2) For road lighting (Lot 2 of the contract) - 4 107.32 MWh - the detailed list of PPE is attached as Annex 1b to the ToR. The forecasted electricity consumption indicated above is indicative and may differ from the amount of energy actually consumed during the contract period. Reduction or increase in the amount of energy consumed does not entail any consequences for the ordering parties (recipients), except for the need to pay for the actually consumed energy at the rates specified in the concluded Agreement. Distribution services will be provided under separate agreements concluded between the ordering parties (electricity consumers) and the DSO operator.
Detailed description of consumption points (EPP) has been included in Appendix 1a to the ToR. Estimated electricity consumption during the term of the Agreement (+/- 10%) 5 173.59 MWh, of which: Zone I 4 098.90 MWhZone II 1 039.39 MWhZone III 35.30 MWhThe above data are indicative. The contractor should take into account possible fluctuations in electricity consumption.4. Deliveries will take place between 01.01.2021 and 31.12.2021, with the reservation that details of the delivery dates (start and end dates) for individual points of consumption are described in the Annex No. 1a to the ToR column "Delivery Period".5. The current electricity supply contracts will expire or be terminated with effect from the day preceding the planned start date (column "Delivery Period"). The obligation to terminate the contracts lies with the ordering parties (customers).6 Measuring systems with tariff group B are adapted to the supplier switching procedure.7 Quality standards: The subject matter of the order is the supply of electricity with quality standards defined in accordance with the applicable regulations. The quality standards of electricity are described in the Act of April 10, 1997. - Energy Law and the Regulation of the Minister of Economy dated May 4, 2007 on detailed conditions of operation of the power system (Journal of Laws of 2007 No 93, item 623, as amended). The principles for shaping and calculating the tariffs and settlements in electricity trading are specified in the Minister of Energy Decree dated March 6, 2019. (Journal of Laws of 2019, item 503).8. The CPV code, under which the subject of the contract was classified: 09300000-2 - Electricity, heat, solar and nuclear energy and 09310000-5 - Electricity.9. The Contractor, based on the Power of Attorney granted, will be obliged to submit, on its own behalf and on behalf of the ordering parties (recipients), contracts for sale of electricity to the relevant DSO, in accordance with the applicable regulations.10As a result of the settlement of the public procurement procedure will be concluded 1 agreement.11. The Contractor will be required to provide a performance bond in the total amount of 5% of the value of the contract.12: The Contracting Authority informs that in accordance with Article 24aa of the PPL Act provides for the possibility of first evaluation of tenders, and then examine whether the contractor whose tender was evaluated as the most advantageous, is not excluded and whether the contractor meets the conditions for participation in the procedure. If the economic operator referred to in the first sentence evades the conclusion of the contract, the contracting authority shall examine whether the economic operator which submitted the highest bid among the remaining tenders is not subject to exclusion and whether it meets the conditions for participation in the procedure. The Contractor will be required to provide a performance bond in the total amount of 5% of the value of the concluded agreement.11. The Ordering Party requests a deposit in the amount: The Contracting Authority informs that in accordance with Article 24aa of the PPL Act provides for the possibility of first evaluation of tenders, and then examine whether the contractor whose tender was evaluated as the most advantageous, is not excluded and whether the contractor meets the conditions for participation in the procedure. If the economic operator referred to in the first sentence evades the conclusion of the contract, the contracting authority shall examine whether the economic operator which submitted the highest bid among the remaining tenders is not subject to exclusion and whether it meets the conditions for participation in the procedure.
