Description

The subject matter of the contract is the delivery of electricity to the facilities listed in Appendix No. 1A, 1B to the SWZ - description of the subject matter of the contract, divided into parts. The electricity demand in the period from 01.01.2022 to 31.12.2023 for the individual parts is 4.1.1 Part I of the contract - street lighting: 3,357,362 kWh (planned order), according to Appendix No. 1A to the SWZ - description of the subject matter of the order. The planned increase/decrease to 30% is: 1,007,208 kWh.4.1.2 Part II of the contract - other facilities: 9,980,986 kWh (planned order), according to Attachment No. 1B to the SWZ - description of the subject matter of the order. The planned increase/decrease up to 30% is: 2 994 297 kWh.
4.1 The subject matter of the present procurement is the supply of electricity to the facilities listed in Appendix No. 1A - description of the subject matter of the procurement. The electricity demand during the period from 01.01.2022 to 31.12.2023 for the 1st part of the contract - street lighting 3,357,362 kWh (planned order), according to Appendix No. 1A to the SWZ - description of the subject matter of the contract. The planned increase/decrease up to 30% is: 1,007,208 kWh.4.2 Each Bidder may submit a bid for any number of parts of the contract, but only one bid may be submitted for one part. Detailed scope of the contract has been defined in Appendix No. 1A to the SWZ, according to the provisions of the Energy Law Act of 10 April 1997. Other terms and conditions of the contract have been specified in the draft electricity sales agreement - Appendix No. 2A to the SWZ. 4.4. - 4.4. The supply of electricity shall take place in compliance with the terms and conditions set forth in the Energy Law and the secondary legislation thereto, in particular with the customer service quality standards set forth in the Ordinance of the Minister of Energy of 6 March 2019 on the detailed rules for the development and calculation of tariffs and settlements in the trade in electricity. The quality parameters of electricity in the distribution part shall be governed by the Ordinance of the Minister of Economy of 4 May 2007 on detailed conditions for the operation of the power system. Distribution services shall be provided under a separate agreement concluded by the Ordering Party with a competent Distribution System Operator (hereinafter referred to as DSO) - the DSO data is included in Appendix 2A to the SWZ. Standby sales are provided by: Enea S.A., Tauron Sprzedaż Sp. z o.o.4.6. The requirements (obligations) imposed on the Contractor are described in the draft sales agreement constituting Attachment No. 2A to the SWZ. Execution of actions resulting from the power of attorney constituting Attachment no 2 to the Agreement for the sale of electricity, hereinafter referred to as the Agreement. The Contracting Authority shall grant the Contractor selected in the procedure the power of attorney.4.7. The current electricity sales agreements with the current electricity suppliers for the electricity points indicated in Appendix No. 1A SWZ are concluded for a definite and indefinite period of time, and a detailed description for each of the PPE points is provided in the column entitled "Agreement Term / Termination Period".4.8..9 In the course of performance of the Agreement the Ordering Party reserves the right to decrease or increase the total amount of purchased energy up to 30%, relative to the electricity consumption specified in paragraph 4.1 above. The circumstances referred to above shall result in the reduction or increase of the remuneration due to the Contractor under this Agreement. The increased or decreased amount of electricity shall not constitute grounds for any claims on the part of the Contractor. 4.10. During the term of the Agreement the Ordering Party shall have the right to change the tariff groups and contracted capacity for individual EPP as specified in Appendix 1 to the Agreement, after prior arrangement of the technical conditions for such changes with the Distribution System Operator, hereinafter referred to as DSO. Changes in the Agreement shall be made upon written notification of the Ordering Party to the Contractor, starting from the change made by the DSO. The aforementioned changes shall be made pursuant to the rules set forth in the tariff of the Distribution System Operator applicable to the Ordering Party and shall concern, in particular, ensuring proper operation of the facility in question (in accordance with its intended use) and/or reduction of distribution service costs. 4.1 The subject matter of this order is the supply of electricity to the facilities listed in Appendix 1B - Description of the subject matter of the order.
