The estimated amount of energy supplied during the supply period is 7 764 992kWh, divided into consumption in the following tariff groups Tariff Estimated quantity 1. C-11 917 404 kWh 2. C-12A 881 368 kWh 3. C-21 385 038 kWh 4. C-22 A 3 036 984 kWh5. C-22 B 2 177 880 kWh6. G-11 135 914 kWh7. G-12 230 404 kWh3.The Ordering Party declares that the energy consumption forecast indicated above and in Appendix No. 6 to the SWZ is only an approximate value that may change during the execution of the Agreement. The actual energy consumption (more or less than the energy consumption forecast in Appendix 6 to the ToR) will depend solely on the actual needs of the Ordering Party, but regardless of the amount of consumption, the Seller is obliged in each case to use the net unit energy prices offered in the tender. The Seller may not pursue any financial claims (e.g. compensation) from the Ordering Party, if during the term of the agreement the Ordering Party purchases from the Seller less or more electricity than the forecasted amount of energy indicated above and in Appendix No. 6 to the ToR, in particular due to the increase or decrease of the number of the Ordering Party's EPPs, change of tariff group, change of the ordered power or technical parameters of EPPs, actual energy consumption of individual EPPs.5The amounts of electricity given in the table above are estimates to determine the value of the contract, which does not reflect the actual or declared use of electricity during the term of the contract. The Purchaser shall be accounted for during the contract term based on the actual, current electricity consumption without any limits on electricity consumption. The price quoted in the bid for 1 kWh for the actual electricity consumed shall apply.6. The Contractor must have a valid and binding GENERAL DISTRIBUTION CONTRACT with the Distribution System Operator (DSO) competent for the Customer. The Contractor shall be obliged, prior to entering into agreements with the Ordering Party, to conclude agreements (if it does not have any) with an operator of the electricity distribution or transmission system in the area of performance of this contract for each entity.7. In the event of failure to meet the quality service standards, the Ordering Party, upon its written request, shall be entitled to a discount according to the rates set forth in the Regulation of the Minister of Economy of 2 July 2007 on the detailed rules for the development and calculation of tariffs and billing in the trade in electricity or in any later legal act specifying these rates.8.The Contracting Authority shall have the right to amend the provisions of the concluded agreement (including Appendix no. 6 to the SWZ) in relation to the contents of the offer, which was the basis for selection of the Contractor, in case of changing the tariff group, changing the ordered power or technical parameters of PPE. In such a situation, the parties to the agreement shall sign an annex to the agreement, and settlements shall be made on the basis of unit prices indicated in the Contractor's bid, appropriate for the changed tariff group. The number of EPPs can be changed only within the tariff groups specified in the CSG and in the bid form.9. In attachment no. 6 to the SWZ, the periods of validity of the current agreements have been specified as well as the periods of termination of comprehensive agreements for points with the first change of seller.
