Description

1) The subject matter of the contract is a comprehensive delivery of electricity, including the sale of electricity and provision of electricity distribution services for the off-take points located within the area of ENERGA Operator S.A. 2) The list of the off-take points describing the data identifying the electricity off-take points (hereinafter referred to as EPP) constitutes Appendix No. 2 to the SWZ. 3) The draft contract provisions constitute Appendix No. 6 to the SWZ.
1) The subject matter of the order is a comprehensive supply of electrical energy, including the sale of electrical energy and the provision of electrical energy distribution services for points of consumption located in the area of ENERGA Operator S.A. The estimated quantity of the basic contract is included in the Price Assortment Form enclosed as Attachment 1 to the SWZ. 3) The sale of electricity and the provision of distribution services will be carried out in compliance with the provisions of the Energy Law of 10 April 1997, the secondary legislation thereto, in particular the Decree of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the power system, the currently applicable tariff for the distribution of electricity of the relevant DSO, approved by the President of the Energy Regulatory Office, the Distribution Grid Operation and Maintenance Manual, generally applicable provisions of law, as well as unit prices of active energy determined after the conclusion of the public procurement procedure4.) Terms and conditions of the contract are set out in the Draft Contract Terms and Conditions - see appendix 6 to the SWZ5) The unit active energy offer price for a given tariff shall result from the Assortment Price Form attached as appendix 1 to the SWZ. Due to the fact that the Contracting Authority is a payer of excise tax on energy purchased for its own use and holds concession No. WEE/1707/19102/W/3/2011/MOS dated 01.10.2018 for electricity generation in Poland. for the production of electricity in renewable energy sources installations valid until 31.12.2030, under which, in accordance with Article 534, paragraph 1, point 2 of the Act of 20.07.2017. 6) Location, technical data of the consumption points and the planned baseline electricity consumption for the year 2022 are included in Appendix 2 to the SWZ. This demand was determined on the basis of electricity consumption in 2020 and the first half of 2021, and the expected consumption estimates for 2022. 7) The Contractor has the right to notify new EPP, however increasing the consumption points or changing the tariff group is only possible within the tariff groups specified in the SWZ and priced in the Contractor's price list. 8) The Contracting Authority has the right to withdraw from the PPE due to e.g. change of RZGW's location (address) or its organisational unit, and thus the PPE. 9) The Contracting Authority requires that settlements for the energy received are made in settlement periods applied by the DSO, according to the actual consumption, with the payment deadline for invoices for the delivered electricity and distribution services set at 30 days from the document issue date.11) The Contracting Authority informs that it holds comprehensive contracts for the sale of electrical energy for the PPE points listed in Appendix 2 to the SWZ. 12) The Contracting Authority guarantees that it will collect at least 30% of the estimated amount of electrical energy specified in the Price Assortment Form.
