Description

The subject matter of the contract is the supply of electricity. A detailed list of EPP and description of the subject matter of the contract has been specified in appendix no. 1 to the SWZ - description of the subject matter of the contract.
The subject matter of the contract is the supply of electricity to 2 delivery points (hereinafter referred to as "PPE") with a total estimated volume of 1263 MWh. The Ordering Parties have determined the minimum consumption to be 50% of the volume indicated above. 2. A detailed list of EPP and description of the subject matter of the contract has been specified in Annex 1 to the SWZ - Description of the subject matter of the contract. 3. the Ordering Party does not allow for partial bids. The Contracting Authority shall not divide the contract into parts, due to the desire to achieve the effect of scale, which can only be obtained with a large volume. Additionally, taking into consideration the complicated situation on the energy market, the Contracting Authority believes that large volume will be helpful in obtaining a stable price offer. The above forecasted electricity consumption is indicative and may differ from the actual amount of energy consumed during the contract period. Any decrease in the amount of energy consumed shall not entail any consequences for the Ordering Party (Customer), except for the need to pay for the energy actually consumed according to the rates specified in the concluded Agreement. The amount of energy consumption under the Agreement shall not be less than 50% of the volume indicated in clause 1 (minimum performance level). The subject matter of the contract shall be executed based on the draft contract provisions - Model contract for the sale of electricity, i.e. Appendix 9 to the SWZ, and the unit purchase price for 1 MWh of active electricity for the entire delivery period shall be determined based on the offered active electricity sale price [PLN/MWh]. The order quantity is the amount estimated for each of the electricity consumption points, with due diligence based on the actual electricity consumption to date. The above data are for information purposes only, they serve only to calculate the bid price and cannot be the basis for any claims by the Contractor. The Contractor's remuneration shall be calculated according to the unit prices specified in the bid and the actual electricity consumption at individual consumption points. 10.The Contractor shall be obliged to act as the entity responsible for the commercial balancing of the electricity sold under the subject matter of the contract.11.The Contractor, based on a power of attorney, shall be obliged to notify the relevant DSO on behalf of itself and the Customer, in accordance with the applicable regulations. Note: The Contractor shall report the consumption points only on the basis of data provided (after concluding the power sales agreement) by the Ordering Party or its proxy to change the electricity seller.Due to technical limitations, the full content of the description of the subject matter of the contract is enclosed as Attachment No. 1 to the Terms of Reference.
