Description

The subject matter of the contract is:Delivery of disposable medical and cardiac surgical equipment from items 1 to 32 The Ordering Party allows submitting partial offers.Parts of the contract are the individual tasks specified above, i.e. tasks from 1 to 32.The Ordering Party informs that the Economic Operator can submit an offer for up to 32 tasks (without limitation of the number of tasks per one Economic Operator). (A detailed description of the subject matter of the contract is included in Annex 2b.
3.3 The Ordering Party's requirements regarding the subject matter of the contract: 1) The offered medical product must have approvals, certificates and be registered in accordance with the law requiring the possession of approvals, certificates and registration,2) The offered medical product must be marketed and used in accordance with the requirements of the Act of 20 May 2010 on medical devices (Journal of Laws of 2021, If the offered medical device does not require registration with the President of the Office for Registration of Medicinal Products, Medical Devices and Biocidal Products, the Contractor shall be obliged to perform at his own expense and within his own scope all activities necessary to meet all legal requirements related to placing the device on the market and using it in the territory of the Republic of Poland. In the cases where the description of the subject matter of the contract includes trademarks, patents or origin, source or specific process that characterizes certain products or services provided by a particular contractor, it means that the Contracting Authority cannot describe the subject matter of the contract in a sufficiently precise and comprehensible way, however, in each such situation the Contracting Authority shall accept solutions equivalent to those described above. In such situations any reference to trademarks, patents, origin, source or a specific process that characterizes certain products or services provided by a particular economic operator shall be read together with the words "or equivalent". When describing the subject matter of the contract by reference to standards, technical evaluations, technical specifications and technical reference systems, as referred to in art. 101 par. 1 pt. 2 and par. 3, the Contracting Authority shall allow for solutions equivalent to those described. The draft provisions of the public procurement contract to be introduced into the contract shall constitute the appendices to the SWZ.3.6. In case of any doubts, the Contracting Authority reserves the right to call upon Economic Operators to submit samples of the offered assortment in order to verify its compliance with the descriptions included in the SWZ. Failure to submit the required samples or submission of samples that do not meet the requirements set forth in the SWZ will result in rejection of the offer pursuant to Article 226 (1) (5) of the PPL Act. 214 PAR. INFORMATION ON CONTRACTS ENVISAGED UNDER ARTICLE 214(1)(7) AND (8), IF THE CONTRACTING AUTHORITY INTEND TO AWARD THESE CONTRACTSThe Contracting Authority does not anticipate awarding any contracts as referred to in Article 214(1)(7) of the PPL Act. DESCRIPTION OF CRITERIA WHICH THE CONTRACTING AUTHORITY WILL TAKE INTO ACCOUNT WHEN SELECTING A TENDER'S OFFER, INCLUDING THE WEIGHT OF THESE CRITERIA AND THE METHOD OF EVALUATING TENDERS13.1. The evaluation of tenders will be based on the criteria defined in the ToR and their weightings. Bids will be evaluated on the basis of points separately for each Task. During the evaluation of the offers, the following criteria will be awarded points for each of the evaluated offers, according to the following rules: for all Tasks: PRICE CRITERION, weighting: 60% PRICE CRITERION TIME LIMIT FOR PERFORMANCE OF THE PARTICULAR CONTRACT, weighting: 40%.
