Description

The subject of the contract is successive deliveries with transport of the following fuels: a) Diesel oil in the estimated amount - 4 000 000 litres (4 000 m3); b) Unleaded petrol Pb-95 in the estimated amount - 1 200 000 litres (1 200 m3); c) Unleaded petrol Pb-98 in the estimated amount - 80 000 litres (80 m3)2. The subject matter of the contract is described by the following names and codes of the Common Procurement Vocabulary (CPV): a) 09134220-5 - diesel fuel (EN 590) - diesel oil; b) 09132100-4 - unleaded petrol. 3. The Awarding Entity reserves the right, depending on its needs, to reduce or increase the quantity of diesel oil, unleaded petrol Pb 95 and unleaded petrol Pb 98 ordered in this tender by 20% (plus/minus) in relation to the estimated quantity of fuel specified in item 1.In such a case, the Contractor shall not be entitled to any claims against the Ordering Party, and first of all, a claim for payment for unsolicited fuel.4. Ordering Party's requirements with respect to the subject matter of the order.1). Fuels must meet the quality requirements of the currently binding Polish Standards: a) PN-EN 590+A1: 2017-06/Ap1 - for diesel oil; b) PN-EN 228+A1:2017-06/Ap1 - for unleaded petrol.2). Fuels, i.e. both diesel oil and unleaded petrol PB 95 and unleaded petrol PB 98 must meet the quality requirements specified in the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (Journal of Laws of 2015, item 1680). The technical and chemical parameters must not be inferior to those set out in the Annexes to the said Regulation. The Contracting Authority requires that the diesel oil supplied by the Contractor be suitable for the season of the year and the prevailing temperature conditions. "In accordance with the applicable provisions of law, in the event of discrepancies between the standard and the Regulation, the provisions of the Regulation shall apply "3). Each fuel delivery must be accompanied by a current quality certificate from the fuel manufacturer, issued by an accredited laboratory, concerning the batch delivered. The certificate must: a) contain data characterizing the delivered fuels; b) be provided with the date of the test; c) be performed not earlier than 7 days before the delivery.4). The Contractor shall be obliged toa) indicate the fuel producer from whom he will purchase fuel for resale to the Awarding Entity by submitting an appropriate statement to that effect, and if the Economic Operator is at the same time a fuel producer - makes a statement that he is a fuel producer and that fuel supplied to the Awarding Entity comes from his own production, a statement for the above mentioned circumstances is included in the tender form; b) make a statement that the fuel offered is produced in accordance with the standards required by the Awarding Entity and is transported in accordance with the requirements of specific regulations on the transport of hazardous materials specified in the ADR Agreement - a statement for that circumstance is included in the tender form;5). The Contractor will cover deliveries to the Ordering Party with a company quality control system enabling identification of possible irregularities in the process of storage, loading and transport of fuel. A statement to this effect is included in the offer form.
