Description

A. The scope of the order includes: 1. type of transaction: credit financing the coverage of the budget deficit during the transitional year in the amount of up to PLN 5,000,000.00; 2. financing period: from the day of concluding the agreement to 31.12.2020; 3. financial period of interest repayment: monthly; 4. loan interest rate: variable interest rate. 5. the method of determining the interest rate: the interest rate for a given interest period shall be based on WIBOR 1M rate for the last day of the month preceding each interest period plus the bank's margin;6. The bank's margin presented in the offer may not be increased during the credit agreement;7. total amount of preparatory fees and commission on the granted credit: no commission;8. bank fees and commissions: the bank will not charge any other fees for granting, servicing and repayment of the credit, including early repayment of the credit, than the interest rate specified in item 4.9. The Ordering Party does not provide for the payment of a single preparatory commission on the granted loan;10. loan collateral: a "blank bill of exchange" together with a bill of exchange declaration, which may include a treasurer's countersignature;11. the loan should be made available within 2 business days of the Ordering Party's presentation of a written instruction to disburse;12. interest on the loan drawn will be calculated by a bank and paid by the Ordering Party every month on the basis of a written notice issued by a bank;13. the Ordering Party reserves the right to disburse the loan in whole or in part. The Contracting Authority informs that the following materials, such as drafts, city council resolutions, reports, RIO opinions, etc. are available on the BIP website of the Kędzierzyn-Koźle City Hall: in the "Tasks of the Municipality; Finances" tab and in the "City Council; Resolutions" tab.Pursuant to Art. 29(3a) of the Public Procurement Law, the Contracting Authority requires that the Contractor or a subcontractor, on the basis of an employment contract, employ persons performing the following activities necessary for the performance of the contract: administrative activities related to credit service, the manner of documenting the employment, the Contracting Authority's powers of control and sanctions for non-compliance with the requirements are specified in Part II of the ToR - Material provisions of the contract. The Ordering Party informs that the financial service related to the granting of a loan is generally available and has strictly defined quality standards as well as regulations and norms in force, specified, among others, in the provisions of the Banking Law Act. The ordered credit granting service is comparable to other services offered on the market. In the case of a credit, the cost of the product life cycle does not occur. Quality standards are described in Section A. A. A detailed description of the subject matter of the contract is set out in this ToR and in Part II.
