Description

1) The loan will be secured with a blank bill of exchange together with a bill of exchange declaration.2) The deadline for granting the loan is the date of payment of funds to the bank account of the Ordering Party.3) The Contractor will make the loan available on the day of signing the agreement without calculating and collecting commissions and fees.4) The loan will be disbursed in tranches to the basic account of the Municipality of Kętrzyn, of which: a) The first tranche in the amount of PLN 429,000 from the day of signing the agreement to 30.11.2019,b) second tranche of PLN 429,000 up to PLN 858,000 by 15 December 2019. The Ordering Party reserves the right to change the above, without incurring fees and commissions.5) The Ordering Party reserves the right not to use the full amount of the loan granted and the right to repay it earlier, without additional fees and commissions.6) The Economic Operator shall not be entitled to charge and collect any additional fees and commissions except for the interest rate on the loan granted, as specified in the offer, consisting of WIBOR 3M and a fixed margin of the Bank.7) The Economic Operator shall not charge any fees and commissions on the loan (commitment) made available and the loan disbursed (used).8) The loan interest rate will be variable, depending on WIBOR 3M (fixed rate in quarterly periods), determined on the basis of the average WBIOR 3M from the previous quarter as a sum of quotations of WIBOR 3M from particular days of the quarter, divided by the number of quotation days in the quarter + fixed margin of the Bank.9) The bank's margin is fixed throughout the term of the agreement.10) The capitalization of interest is unacceptable.11) Interest will be repaid monthly, by the 10th day of each month for the previous month, starting from the month following the month of the credit disbursement.12) The amount of interest to be repaid will be notified by the Contractor to the Ordering Party by the 5th day of each month for the previous month, excluding the total repayment of the credit.13) The condition for payment of interest is a written notification in electronic form (e-mail) or in a paper version of the Ordering Party by the Contractor about the amount of interest due in a given month, sent by the 5th day of each month for the previous month.14) The condition for payment of interest is a written notification by e-mail or in a paper version of the Ordering Party by the Contractor about the amount of interest due in a given month, sent by the 5th day of each month for the previous month.14) The amount of interest to be repaid will be notified by the Contractor by the 5th day of each month for the previous month.) The Contractor shall charge interest on the amount of credit actually drawn down by the Purchaser less capital instalments for the actual number of days of credit use, assuming that interest is calculated on a calendar year basis (365 days in a year or 366 days in a leap year).15) By the end of each month, the bank shall send a bank statement of the interest repaid on the credit in question.16) If the date of credit or interest repayment falls on a statutory holiday, it is considered that the deadline has been met if the repayment took place on the first business day after the date specified in the agreement.17) All payments resulting from the agreement will be payable in Polish zlotys.18) The Contracting Authority requires that the Contractor, while performing the subject of the contract, employs the Contractor on the basis of an employment contract within the meaning of Article 22 § 1 of the Act of 26.6.1974. - Labour Code or the corresponding form of employment specified in the regulations of the member states of the European Union or the European Economic Area of the person(s) who will perform administrative and accounting services for the subject of the order (position(s) related to credit service, in the scope of which will be performed exemplary activities: maintenance of the borrower's account, calculation of interest, determination of current balances).
