PUBLIC TENDER NOTICE
ETS-CP19-031

BRIEF DESCRIPTION
The École de technologie supérieure, 1100 Notre-Dame Street West, Montreal (hereinafter referred to as "Owner"), is requesting Bids in order to award a contract to be performed on demand for electrical work whose approximate monetary value is estimated at one million five hundred thousand dollars ($1,500,000). This work is required to meet the Owner's redevelopment, renovation and asset maintenance needs and will be carried out in the various buildings on his campus located in Montreal in the Ottawa, de la Montagne, St-Jacques and Montfort streets block. Work could also be carried out in other nearby premises. The buildings where the work is carried out remain in operation during the work.

CONTRACT DURATION
The start of the Contract is October 1, 2019.
The Contract shall be valid for a maximum period of three (3) years. However, the Owner reserves the right, at its sole discretion, to terminate the Contract as soon as the amount of work performed reaches the Contract Value, regardless of the time period between the commencement of the Contract and that time.

MANDATORY INFORMATION SESSION AND SITE VISIT
Bidders are invited to an information session and visit the site. Attendance at the information session and visit is mandatory.
The information session and visit will take place on Wednesday, August 14, 2019 at 2:00 p. m. Bidders must report to 1100 Notre-Dame Ouest in Montreal, room A-1410.
The information session and visit are at the expense of each Bidder. They will allow Bidders to review the requirements of the Contract and obtain all relevant information, as well as verify any conditions that may affect their Bid.
A representative of each Bidder present at the information session and visit must ensure that they have signed the attendance sheet provided by the Owner, indicating the name and title of the Bidder's representative(s) present during the on-site visit, as well as the name of the Bidder. ¬ If they do not sign the attendance sheet, their Bid will automatically be rejected.

BID SECURITY
The Bidder must provide with its Bid, a bid security of twenty-five thousand dollars ($25,000). The bid security is in the form of a bond issued by a financial institution and must comply with the requirements of Schedule 1 of the Regulation respecting contracts for construction work by public bodies, money orders or certified cheques payable to the order of the École de technologie supérieure.
The bid security must be valid for a period of forty-five (45) days from the deadline for receipt of Bids.
PERFORMANCE GUARANTEE AND GUARANTEE OF THE CONTRACTOR'S OBLIGATIONS FOR PLEDGES, MATERIALS AND SERVICES
The performance bond and the guarantee of the contractor's obligations for pledges, materials and services in the amount of twenty-five thousand dollars ($25,000) each are in the form of a bond issued by a financial institution and must comply with the requirements of Schedules 2 and 3 of the Regulation respecting contracts for construction work by public bodies.
The performance bond and the contractor's obligations for pledges, materials and services shall remain in effect for the duration of the Contract. Where applicable, the Contractor shall provide proof of the renewal of these guarantees prior to their expiry for the duration of the Contract.

INTERGOVERNMENTAL AGREEMENTS
The following Agreements apply to this call for tenders:
- Canadian Free Trade Agreement
- Agreement on the Liberalization of Public Procurement in Quebec and New Brunswick
- Trade and Cooperation Agreement between Quebec and Ontario

TENDER DOCUMENTS
The Bidding Documents are available only through the electronic bidding system (hereinafter referred to as "OACS").

Failure by the Bidder to comply with the procedure for requesting information may result in the rejection of its Bid.
No verbal information is binding on the Owner and may not be interpreted as modifying the Bidding Documents.

RECEIPT OF BIDS
The Bidder must submit its Bid no later than August 26, 2019 at 11:00 a.m. (local time in effect).
To be validly received, all Bids must have been delivered to the Owner's Supply Department located at the civic address and premises mentioned below no later than the deadline for submitting Bids:

The Supply Operations Department is open from 8:30 a.m. to 12:00 p.m. and from 1:30 p.m. to 4:00 p.m., Monday to Friday.
The Bidder must send its Bid by courier, regular mail or in person to the above civic address and location. Fax or e-mail are not acceptable methods of transmission.
Any Submission that does not comply with the above conditions will automatically be rejected.
The Owner will reject any Submission that is not received by the date, time and place mentioned above for the submission of the Submissions. In addition, the Owner is not responsible for the delays inherent in the internal transmission of any shipment that is not received directly by the Supply Department.
BID OPENING
Bids will be opened publicly, in the presence of a witness, at the Procurement Department of the École de technologie supérieure, local B-1300, immediately after the deadline for their submission, and Bidders are invited to attend.

ELIGIBILITY REQUIREMENTS
Failure by a Bidder to comply with any of the eligibility requirements described in this Invitation to Tender renders it ineligible to submit a Bid. To this end, the Bidder:
- and its employees must have the necessary qualifications, authorizations, permits, licenses, registrations, certificates, accreditations and attestations;
More particularly and without limiting the generality of the foregoing, the Bidder:
o must hold a specialized contractor's licence to carry out electrical work in accordance with the Building Act, RLRQ c B-1.1;
o must have at least three (3) years' experience in the execution of redevelopment or renovation contract(s) in a building in operation for electrical work in the institutional, industrial or commercial environment;
o must have at least fifteen (15) regular employees within his company;
- must have requisitioned, completed and signed the Bidding Documents on its behalf only, as indicated in section 1.11;
- must hold the Attestation of Revenu Québec, as described in section 1.15;
- and its directors must not have taken any of the actions described in the Bidder's Probity Certification Form (Appendix B). The Bidder must sign a declaration to this effect, as specified in Article 1.16;
- must provide a letter of commitment, issued by a Financial Institution, stating that if the Contract is granted and accepted, it will issue a performance bond and a bond for the Contractor's obligations for pledges, materials and services as defined in section 1.20;
- must have the insurance coverage specified in Article 2.3 or provide a letter of commitment issued by an insurance company stating that if the Contract is granted and accepted, it will issue insurance coverage as described in Article 2.3;
- must have in Québec or in a territory covered by an applicable intergovernmental agreement, an establishment where it carries on its activities on a permanent basis, clearly identified in its name and accessible during normal business hours;
- must not be entered in the register of companies not eligible for public contracts (RENA) or, if entered, that its period of ineligibility for public contracts has ended, as detailed in Article 1.12;
- must have attended the information session and the mandatory site visit and signed the attendance sheet;
- must be a private legal entity, a general, limited or joint partnership or a sole proprietorship;
- must hold the authorization to contract with a public body prior to obtaining a public contract issued by the Public Procurement Authority (PPA), as detailed in Article 1.17, if the amount of the Bid so requires;
- must meet any other eligibility requirements set out in the Bidding Documents.

COMPLIANCE REQUIREMENTS
Any Submission containing one of the following non-conformities will be deemed non-compliant and will be automatically rejected:
- Failure to comply with the place, date and time limit set for the receipt of Bids;
- Form 1 was not used to submit the Bid, as required in Article 1.10;
- Form 1 was not submitted in the Bid envelope;
- the submitted price has not been indicated on Form 1, as required in section 1.10;
- Form 1 has not been signed by an authorized person, as required by section 1.10;
- a deletion or correction made to the submitted price and not initialled;
- a Conditional or Restrictive Submission;
- the Bid which includes an abnormally low price within the meaning of the Regulation respecting construction contracts for public bodies;
- the Bid was not submitted in an opaque and sealed envelope, as required by Article 1.10;
- if the Bidder submits more than one Bid for this Invitation to Tender, all Bids submitted by the Bidder will automatically be rejected;
- the presentation of a guarantee not complying with the form and conditions required;
- failure to comply with any other compliance condition indicated in the Bidding Documents as automatically resulting in the rejection of a Bid.
Any omission or error other than those referred to in the preceding paragraphs with respect to a Submission will not necessarily result in the rejection of the Submission. The Owner may allow the Bidder to correct it within a period of time to be determined by the Owner. The correction made must be to the satisfaction of the Owner and may not result in an increase in the price submitted.

UNSATISFACTORY PERFORMANCE EVALUATION
The Owner reserves the right to refuse any Bidder who, during the two (2) years preceding the opening date of the Bids, has received an unsatisfactory performance evaluation from the Owner, has failed to respond to a bid or contract or has been the subject of a contract termination due to its failure to comply with its terms.

FULL SUBMISSION FOR SINGLE AWARD
The Owner does not undertake to accept the lowest or any of the Bids received, nor to carry out the subject matter of this call for tenders, nor to carry out only part of it and may, at its sole discretion, do nothing in connection with this call for tenders, without any compensation to the Bidders.

Please note: In this document, any terms mentioned in the masculine gender also include the feminine gender and vice versa. Similarly, any term mentioned in the singular includes the plural and vice versa.
