The subject of the contract is the execution of the investment task consisting in the comprehensive construction of the interchange together with the construction or reconstruction of the road system, underground and above-ground infrastructure, as well as land development and small architecture, in the "design - build" formula, under the project entitled "Construction of the integrated Grunwaldzka transport interchange at the place of crossing the E20 railway line".The entire subject matter of the contract is subject to performance in accordance with the principles of technical knowledge and engineering art and the generally applicable provisions of law. The subject matter of the contract also includes performance of services / supplies related to the performed construction works. Additional information on the detailed scope of the contract is included in the model contract - Annex 1 to the ToR and Annexes No. 2-3-4 to the ToR.
1.The subject matter of the contract is the performance of works under the investment task under the name: "Rebuilding of the viaduct in the course of Kurlandzka Street together with reconstruction of the road system", in accordance with the principles of technical knowledge and engineering art and generally applicable legal regulations.3.1 The subject of the contract is the execution of the investment task consisting in the comprehensive construction of an interchange together with the construction or reconstruction of the road system, underground and above-ground infrastructure, as well as land development and small architecture, in the "design - build" formula, under the project entitled "Construction of the integrated Grunwaldzka transport interchange in the place of crossing the E20 railway line". Location of the investment: the area covered by the execution is located in Poznań - in two surveying districts: 0036 Junikowo and 0041 Plewiska, as well as in Plewiska, and in Komorniki Commune - in the fifth geodesic area of Plewiska. Near the area envisaged for the investment there are both residential and industrial buildings with commercial and service outlets. Grunwaldzka Street is a district road of G class (it is assumed that it will be lowered to Z class in the section of the investment), with asphalt surface. The street in its existing state has a baseboard section and is framed with curbs. Other existing streets within the scope of the investment are in particular: - Piwoniowa Street - a link from Grunwaldzka Street to Szarotkowa Street - Szarotkowa Street - Twardogórska Street and a fragment of Krobska Street - Wołczyńska Street - a fragment of Owsiana Street2. The estimated contract value exceeds the amount specified in the regulations issued pursuant to Art. 11 section 8 of the Public Procurement Law.3 The Awarding Entity envisages awarding contracts referred to in Art. 67 par. 1 item 2. 3. The Contracting Authority shall provide for awarding contracts referred to in art. 67 par. 1 item 6 of the Act in the event of circumstances referred to in art. 67 par. 1 item 6 of the Act (up to 20% of the basic contract value). The subject matter of the aforementioned contracts shall be similar works or services, compliant with the subject matter of the basic contract. The Contracting Authority shall provide for awarding such contracts in particular when it is necessary and/or necessary to perform the scope of works not included in the scope of the basic contract, and whose performance will be possible by repeating similar works or services as provided for in the scope of the basic contract - in particular in the scope subject to the CPV classification for the basic contract, as indicated in item 1.6 of the Act (up to 20% of the value of the basic contract). 3.2. OF THE TOR. Similar contracts may include in particular:- construction / reconstruction of roads, carriageways, sidewalks;- construction / reconstruction of railway infrastructure (platforms, waiting rooms, sheds, tracks, traction, traffic control equipment);- construction of retaining walls;- reconstruction of existing crossings with side roads;- construction / reconstruction of parking bays; - reconstruction of sidewalks; - reconstruction of existing exits; - installation of new concrete kerbs and edges; - height adjustment of existing third-party equipment (telecommunication wells, water supply valves, gas valves);- construction of field stone bands;- reconstruction of field stone bands;- reconstruction of green belts (humming and sowing of lawns in the roadway);- construction of street lighting;- construction / reconstruction of rainwater sewers;- construction / reconstruction of technological sewers;- cutting of trees and shrubs;- planting of trees, shrubs and perennials;- execution of horizontal and vertical marking;- design works.4The Contracting Authority provides for the possibility of amending the future contract with the Contractor in accordance with the provisions of the model contract and the provisions of the Act.5 In matters not regulated by the ToR (and the announcement, respectively), or in the case of discrepancies between the provisions of the ToR (and the announcement, respectively) and the Act, the provisions of the Act shall apply accordingly and prevail.
