Description

The basis for the implementation of the Project will be a public-private partnership agreement (hereinafter: the Ppp Agreement) concluded between the Municipality of Płock (hereinafter: Public Entity, Contracting Authority)A Private Partner (hereinafter: also: the Contractor), selected in the proceedings conducted pursuant to the Act of 21.10.2016 on the Concession Agreement for Works or Services (Journal of Laws of 2016, item 1920 as amended, hereinafter: the Act on Concession Agreement), taking into account the provisions of the Act on Ppp. The private partner will be responsible for the design, financing and execution of construction works for the Sports and Recreation Centre in Płock on the Sobótka Reservoir and the maintenance of the infrastructure. The Private Partner's remuneration will primarily be the exclusive right of exploitation, including the right to derive benefits from the object designed, financed and built by the Private Partner within the framework of the Project (Article 4, paragraph 2 of the Act on Industrial Property Rights in conjunction with Article 3, paragraph 2 of the Act on Concession Contracts). The Public Entity allows, after the completion of the realization of the Project, possible transfer of ownership rights to a part of the Real Property to the Private Partner, while the method of this transfer will be the subject of negotiations.
