Description

Supervision services according to the FIDIC (The International Federation of Consulting Engineers) Contract Conditions (the FIDIC Engineer) and relevant national legislation for the reconstruction of the existing port area and quay of approx. 16 ha and 167 m respectively, and construction of a new part of the port terminal for bulk and general cargo of an area of approx. 30 ha and a quay length of approx. 230 m, as upstream extension of the existing port area. The Works to be supervised also include the access road and port infrastructure and utilities (e.g. internal roads and railways, sewerage, water, power supply). The existing port facilities shall be operational during the Works. The Contract will be managed according to the FIDIC Conditions of Contract for Construction for building and engineering works designed by Employer (FIDIC RED Book, First Edition 1999).
Guide to Procurement (GtP) for projects financed by the EIB from September 2018 (https://www.eib.org/attachments/strategies/guide_to_procurement_en.pdf ) is applied to this tender, while tender document templates are from the PRAG (Practical Guide for Procurement and Grants for European Union external actions – August 2020).Participation is open to all-natural persons and firms (participating either individually or in a grouping - consortium - of tenderers) originating from all countries of the world.All eligible natural and legal persons or groupings of such persons (consortia) may apply.A consortium may be a permanent, legally-established grouping or a grouping which has been constituted informally for a specific tender procedure. All partners of a consortium (i.e., the leader and all other partners) are jointly and severally liable to the Contracting Authority (CA).The participation of an ineligible natural/legal person will result in the automatic exclusion of that person. If that ineligible person belongs to a consortium, the whole consortium will be excluded.Only one application or tender can be submitted by a person whatever the form of participation (as an individual legal entity or as leader or partner of a consortium submitting an application/tender). If a natural or legal person submits more than one application or tender, all applications or tenders in which that person has participated will be excluded. Further information related to the submission of application is given in Section VI (Additional Information).Grounds for exclusionAs part of the application form, candidates must submit a signed declaration, included in the standard application form, to the effect that they are not in any of the exclusion situations listed in Section 2.6.10.1. of the PRAG (August 2020), as well as in the GtP (September 2018) for projects financed by the EIB (https://www.eib.org/attachments/strategies/guide_to_procurement_en.pdf), Section 1.4 (Ethical Conduct), Section 1.5 (Conflict of Interest), Section 1.7 (mandatory compliance with EIB's E&S safeguards) and Section 3.6 (Prohibited Conduct – Covenant of Integrity (CoI)– template available in EIB GtP, Annex 3), Anti-fraud policy of the EIB (http://www.eib.org/infocentre/publications/all/anti-fraud-policy.html) and Section 3.8 E&S Covenant (template is available in EIB GtP, Annex 7). It should be noted that, in the CoI, the tenderer is requested to self-declare all sanctions and/or exclusions (including any similar decisions having the effect of imposing conditions on the tenderer or its subsidiaries or to exclude the said tenderer or its subsidiaries, such as temporary suspension, conditional non-exclusion, etc.) imposed by the European institutions or any multilateral development banks (including the WB Group, the African Development Bank, the Asian Development Bank, EBRD, EIB or Inter-American Development Bank), regardless of the date of issue and the expiration or not of such decisions and of the current status of any sanction and/or exclusion. In this regard, any omission or misrepresentation, made knowingly or recklessly, may be considered as fraud under the EIB Anti-Fraud Policy. Therefore, the Client reserves the right to reject any offer presenting an inaccurate or incomplete CoI, and may cause the rejection of the offer for prohibited conduct.Pursuant to its Sanctions Policy, the Bank shall not provide finance, directly or indirectly, to or for the benefit of an individual or entity that is subject to financial sanctions imposed by the EU, either autonomously or pursuant to the financial sanctions decided by the United Nations Security Council on the basis of article 41 of the UN Charter.Financing - Finance Contract for Serbian Inland waterway infrastructure between the Republic of Serbia and European Investment Bank (“Official Gazette of RS”, No. 2/19) and the budget of the Republic of Serbia.
