2. The material scope of the Agreement covers in particular:1) delivery of electronic equipment covered by the contract in accordance with the Supplier's offer and its appendix with technical parameters of the offered equipment and indication of the manufacturer and model of the given equipment range - appendix no. 1a to the contract (including the cost of purchase / manufacture), insurance for the time of transport, loading, unloading, bringing in, distribution in individual rooms of the kindergarten facility and installation in relation to wall mountings for multimedia boards / wall and ceiling mounts for projectors - in accordance with the description of equipment distribution specified in Appendix no. 3 to the contract;2) delivering the software on CD/DVD media and granting the necessary licenses or confirmation of the software license, unless these licenses are granted to the Purchaser/user of the object directly by the manufacturer;3) installation of the software, comprehensive configuration (including such a configuration that will enable printing on a network printer from any networked computer supplied under this agreement) and start-up of the electronic equipment - completed by conducting control tests, confirmed by a protocol;4) provision of documentation (manuals, technical documentation, usage documentation) - including in the Polish language;5) cleaning of the premises (places related to the works carried out) - after placing the subject of the agreement in the facility;6) one-day training of indicated user's employees in the operation of the supplied equipment and software in the amount of 4 hours. The training will take place after the equipment control tests have been carried out, at the time agreed with the facility user and in the place indicated by the facility user;7) quality guarantee granted for the period resulting from the supplier's offer (not shorter than specified in § 7.1 of the contract and the description of the subject of the contract attachment no. 1) for the supplied equipment and on conditions not worse than the manufacturer's guarantee, confirmed by a separate guarantee document.3The subject of the contract should be brand new, undamaged, free from defects, complete, suitable for its proper operation - in accordance with the functional scope and its intended use specified in Appendix 1 to the contract (Description of the subject of the contract), also marked with the CE mark (Conformité Europe), have the appropriate approvals, declarations of conformity, safety certificates - with applicable standards and regulations. The equipment should be delivered with intact warranty seals.4 The Supplier undertakes to perform the subject of the contract with the utmost care, in accordance with applicable regulations, standards, rules of technical knowledge and to ensure the highest quality of works accompanying the delivery.5The Supplier declares that it has accepted that the works related to the subject of the contract will be carried out in the Object in the course of use, and also ensures that it has the appropriate technical preparation and has access to the equipment that will allow the implementation of the subject of the contract, in accordance with applicable regulations and standards.6. If the Supplier does not provide for delivery and installation within one day, the Supplier shall be fully liable for loss or destruction of electronic equipment covered by the subject of the contract also in a situation when the equipment has been deposited on the premises of the facility.7 The Supplier cannot entrust the performance of the subject of the contract in whole or in part to third parties without prior written consent of the Purchaser. The Supplier is fully responsible to the Ordering Party/User for the work it performs with the help of subcontractors. The Supplier undertakes to pay its subcontractors remuneration based on the legal relationship between them.
