Description

The subject of the order is the delivery of computer equipment and warranty services for the University Clinical Centre of the Medical University of Warsaw in the project "Introduction of modern e-services in medical entities supervised by the Minister of Health".2 The subject of the order should be brand new, manufactured not earlier than in 2020 and ready to work without any additional purchases and investments.3The subject matter of the Order shall be delivered at the Contractor's expense, risk and transport, together with documentation in the Polish language, warranty terms and conditions and a guarantee card.4 The Contracting Authority does not allow for the possibility of submitting a partial tender.5 The terms and conditions of completion of the subject matter of the Order are included in the model agreement, which constitutes Appendix 8 to the ToR.
The subject matter of the Order is the delivery of computer equipment and warranty services for the University Clinical Centre of Warsaw Medical University in the project "Introduction of modern e-services in medical entities supervised by the Minister of Health".2 The subject matter of the Order should be brand new, manufactured not earlier than in 2020 and ready to work without any additional purchases and investments.3 The subject matter of the Order shall be delivered at the expense, risk and transport of the Contractor together with documentation in Polish, warranty conditions and warranty card.4The guarantee period granted by the Contractor should not be shorter than 36 months (for the entire product range), starting from the date of signing the handover protocol (acceptance protocol) for a given contract tranche referred to in ยง 3 item 5 of the model agreement.6 The parameters of the subject matter of the contract presented in the detailed description (Appendix 3 to the ToR) constitute the technical and quality minimum expected by the Awarding Entity. Any product names and their manufacturers, if any, are only intended to approximate the requirements which could not be described with sufficiently precise and comprehensible terms.7 The Awarding Entity allows the delivery of equivalent equipment with respect to the description of the subject matter of the contract, i.e. that the offered subject matter of the contract will have the same or higher technical, quality, functional and utility parameters.8. The trade marks, names, etc. (if any) indicated in the description of the subject-matter of the contract are only a qualitative benchmark for the subject-matter of the contract. In all cases where, due to the specification of the subject matter of the contract, the names of materials were indicated, it is allowed to use equivalent materials, i.e. any named materials used in the description of the subject matter of the contract, serve only to define the standard and may be replaced with others of not worse performance and quality parameters. In the case of tenders containing equivalent solutions, the contracting authority will verify them in terms of meeting the requirements of particular items of the technical requirements included in the annexes to the ToR. The contractor shall be obliged to prove the equivalence of the offered assortment in a tender. The burden of proving equivalence shall be borne by the Economic Operator. The Contracting Authority shall not accept equivalent solutions if they have lower minimum quality requirements than those indicated in the appendices to ToR ToR.9 Possible names of manufacturers included in the description of the subject matter of the contract have been used only for illustrative purposes. The names of products and their manufacturers, if any, are not intended to violate the principle of fair competition and equal treatment of Economic Operators. Wherever they are indicated, they should be read in such a way that they are accompanied by the term "or equivalent". The term "or equivalent" shall be understood by the Contracting Authority as offering materials which guarantee the performance of the contract in accordance with the Contracting Authority's expectations. The use of equivalent solutions may not lead to deterioration of the characteristics of the subject matter of the contract, or to a change in price, or to an infringement of the provisions of law.10 The concept of equivalence also applies when the Awarding Entity described the subject matter of the contract by means of standards, approvals, technical specifications and reference systems.11 The conditions for the performance of the subject matter of the contract are also included in the model contract, which constitutes Annex 8 to ToR.
