Description

The subject of this order is the delivery of computer hardware and software for the CMKP in Warsaw.2 A detailed description of the subject of the order/technical specification is attached as Appendix 1 to the ToR.3 The ordered equipment is designed to edit documents, prepare spreadsheets, web applications and process personal data. The equipment will be used to work both in and outside the office, using a specific operating system and office package. In all cases it may be necessary to additionally secure access to a laptop. The Contracting Authority requires a guarantee for the offered subject matter of the contract to be provided on terms and conditions consistent with those specified in the description of the subject matter of the contract/technical specification constituting Appendix 1 to the ToR and in the model contract constituting Appendix 6 to the ToR.5 The Contractor is obliged to execute the contract on terms and conditions described in the model contract constituting Appendix 6 to the ToR.6 All operating systems/software offered to the Contracting Authority must be adapted to the current IT infrastructure of the Contracting Authority and may not cause the infrastructure to be rebuilt or enlarged.7If the description of the subject matter of the contract specifies any trademark, patent or origin, source or specific process which characterizes products supplied by a particular Economic Operator - it should be assumed that the indicated trademarks, patents or origin, source or specific process are justified by the specific nature of the contract, as it is not possible to describe the subject matter of the contract by means of sufficiently precise descriptions and indicate the technical, operational and performance parameters of the subject matter of the contract, and the Awarding Entity allows offering products with equivalent technical, operational or performance parameters in this respect. At the same time, pursuant to art. 30 item 5 of the PPL Act, a Economic Operator who invokes solutions equivalent to those described by the Awarding Entity is obliged to prove that the subject matter of the contract offered by him meets the requirements specified by the Awarding Entity.8 The subject matter of the contract with equivalent technical, operational and performance parameters shall be considered by the Awarding Entity to be a product with technical, operational and performance parameters not worse than those described by mentioning trademarks, patents or origin. If the equivalent software proposed by the Contractor, being the subject of the contract, does not work properly with the equipment and software functioning at the Ordering Party's premises or causes disturbances in the operation of the Ordering Party's hardware and software environment, the Contractor shall cover all costs related to reconstruction and restoration of efficient hardware and software infrastructure of the Ordering Party and shall reimburse the costs of purchase of software not meeting the conditions of the contract. In order to demonstrate compliance with these requirements, the Contractor shall present the manufacturer's specification confirming the parameters of the offered product in Polish or English - print-outs from the manufacturer's websites are acceptable.9 All information concerning the order in question, which, due to the limited number of characters possible to be entered in the Announcement, is not included in the ToR in force in this procedure, available on the Purchaser's purchasing platform indicated in point I.3 of the announcement.
