Description

The subject of the contract is to provide the Ordering Party, within the scope of its business activity, with a brand new computer-controlled sub-track lathe, together with software in Polish, intended for machining the external outline of wheelsets and brake discs in railway vehicles, to be used (hereinafter referred to as the "Object of Leasing") and to perform the obligations indicated in §5 section 1 of the Model Agreement (appendix 3 to the ToR).
The subject matter of the contract has been specified in detail in the Terms of Reference (hereinafter referred to as the "ToR") and appendices to the ToR, including appendix 2 (Detailed description of the subject matter of the contract) and appendix 3 (Model contract).2 The subject matter of the Lease cannot be encumbered with rights of third parties and must be free of any legal defects.3 The Contractor shall not be entitled to establish a lien on the Leasing Party during the term of the contract or any rights in favour of third parties. The Contractor undertakes to execute the subject of the contract in accordance with the technical documentation, technical specifications for the execution and acceptance of works and the regulations in force in this respect, as well as in accordance with the art of construction.
