Description

The selected network operator must build up the broadband infrastructure in its own name and at its own expense in the underserved areas ("white NGA spots") and operate it for the seven-year earmarking period, thereby ensuring nationwide NGA broadband connectivity with corresponding end-customer products. The broadband infrastructure established in the roll-out areas must enable symmetrical bandwidths of up to 1 Gbit/s to be provided downstream/upstream for residential and commercial customers on each local loop, if required or on request. Not every end-user product offered must be designed in this way. However, retail products must reliably guarantee at least 50 Mbit/s downstream (not just "up to"). The Office does not intend to procure any services from itself for its own economic benefit by awarding the contract. The network operator to be selected in the present procedure shall not receive any fee from the Office. The award is for the selection of a beneficiary and does not concern a public contract. With the successful bidder, a public law grant contract for investment aid to close the profitability gap will be concluded on the basis of the framework regulation of the Federal Republic of Germany on support for the development of Next Generation Access (NGA) broadband coverage (v. 15.6.2015) and the Directive on the Promotion of Broadband Provision in Rural Areas in Schleswig-Holstein - Broadband Directive - of 30.5.2017. The Office has received a (repeatedly amended) notification of subsidy from the Land in accordance with this Directive, the conditions of which become part of the subsidy agreement (also with regard to the municipal share of subsidy).
