Description
The district of Cham intends to implement an area-wide Next-Generation Access (NGA) network in the underserved areas of its municipalities as an FTTB network. The subject of the contract to be awarded is essentially the operation of the system as well as the supply of the previously underserved households with high-performance broadband connections as retail products. The customer intends to lease the passive fibre optic network to be built to the contractor for this purpose for operation after its completion. the corresponding access points for a complete expansion of the remaining white NGA patches have been created by an almost area-wide NGA FTTC expansion in the district of Cham. Only a few FTTC sites are still undeveloped. The households/buildings still to be expanded are predominantly located in sprawling areas. An efficient, future-proof expansion therefore requires FTTB connections. The corresponding passive infrastructure is to be built in the ownership of the district of Cham or its own operations in an operator model. The district of Cham would like to implement more than 5,000 FTTB connections in 37 municipalities in a network with a route length of approx. 1,500 km. For this purpose, the district of Cham intends to apply for federal and state subsidies and lease the passive fiber-optic network to be established for nationwide broadband coverage to an operator. The present invitation to tender is intended for the selection of the latter or for the award of the corresponding service concession. The contract will be awarded in accordance with the European Union Guidelines on the application of State aid rules to the high-speed roll-out of broadband (2013/C 25/01) of 26.1.2010 (OJ L 331, 30.12.2010, p. 1).2013 and the Framework Regulation of the Federal Republic of Germany on Supporting the Development of Nationwide Next Generation Access (NGA) Broadband Provision of 15.6.2015. The Customer shall submit an application for funding in accordance with the Directive "Funding to Support Broadband Development in the Federal Republic of Germany of 22.10.2015", as amended, as amended on 15.11.2018. Furthermore, the client plans to apply for state subsidies under the Directive on the Co-financing of Broadband Subsidies by the Federal Government in the Free State of Bavaria (Co-financing Broadband Directive - KofBbR) of 21.4.2016, which was last amended by the announcement of 5.7.2019 (BayMBl. Nr. 265). it is already pointed out that the above-mentioned guidelines, together with ancillary provisions and the corresponding grant notices, will form the basis of the lease agreement to be concluded with the commissioned company. The contract shall oblige the Contractor to comply with the requirements laid down in the respective notices, funding guidelines and ancillary provisions as they result from their respective current version. The current versions of the funding guidelines, the relevant ancillary provisions and the NGA framework regulation, which is also relevant for funding, are already made known to the participants in the annexes, and the award documents are made available to the bidders to be approved for this purpose at an electronic address in accordance with § 17 (1) KonzVgV in the course of the invitation to tender.
