Description

The scope of the contract covers the maintenance, emptying, substitution, purchase and installation of street waste baskets (including dog excrement baskets) in area no. I and area no. II in road lanes within the city of Lublin. A detailed description of the subject of the contract can be found in the ToR published on the Ordering Party's website in the Public Procurement / Announced section.
1. The scope of the order includes the maintenance, emptying, substitution, purchase and installation of street waste baskets (including dog excrement baskets) in area no. I in the road lanes within the city of Lublin, which consists of:1) purchase, assembly, maintenance and emptying of street waste baskets, dog excrement baskets set up in road lanes; 2) carrying out the emptying of waste baskets and dog excrement baskets in a manner that does not cause contamination of surrounding lawns, roadways, sidewalks and other elements of road lanes, using appropriate vehicles, i.e. vehicles with a lockable chamber for temporary collection and transport of waste, preventing the pollination of the environment, and at the same time allowing the transport of waste in accordance with the requirements of the applicable law;3) collecting or sweeping and collecting waste collected next to the waste bin or the dog excrement bin, including cleaning the area within a radius of 5 meters from the bin, by sweeping the pavement, roadway, platform or cleaning the lawn. If there is a part of a city bench within a radius of 5 meters from the waste or dog excrement bin, the cleaning covers the entire area within the bench;4) providing plastic bags for street waste baskets and dog excrement baskets, each time these baskets are emptied;5) emptying of street baskets and dog excrement baskets in the intervention mode, i.e. 5) emptying street baskets and dog excrement baskets in an emergency mode, i.e. within 2 hours of being notified by a representative of the Ordering Party or the Municipal Police of the City of Lublin, if necessary, and notifying the Ordering Party by phone or e-mail about the work performed;6) installation of new waste baskets in places indicated by the Awarding Entity, purchased by the Contractor, and disassembly of currently used baskets and their reassembly in another location in the road lanes indicated by the Awarding Entity or taking them for storage in the warehouse within three days of the date of written notification by the Awarding Entity; 7) placing, during open-air events or other events, at the Awarding Entity's request, in places indicated by the Awarding Entity in the road lanes, of aesthetic street baskets (i.e. the baskets are placed on the premises of the Lublin City Council or the Lublin City Guard, if necessary, and notifying the Awarding Entity by phone or e-mail about the work performed; 8) placing, during open-air events or other events, at the Awarding Entity's request, in places indicated by the Awarding Entity in the road lanes, of aesthetic street baskets (i.e. the baskets are placed on the premises of the Lublin City Council or the Lublin City Guard. 7) to deliver baskets during open-air events or other events at the order of the Orderer, in places indicated by the Orderer in the road lane, aesthetic street baskets (i.e. in good sanitary and technical condition), owned by the Contractor, within 3 working days from the date of the written order by the Orderer and to empty them at the date indicated in the order, with the frequency indicated by the Orderer;8) to complete the missing elements of the baskets (e.g. stolen, devastated, etc.) within 24 hours from the moment of notification by the Orderer's representative;9) to remove them at the request of the Orderer, the City Guard of Lublin, etc. 9) removing, at the request of the Ordering Party, the Municipal Guard of the City of Lublin, etc., or observing the Contractor's own observations, the remains of destroyed baskets and baskets which are not suitable for repair and further use;10) in the case of finding that the basket has been moved by third parties to another place, informing the Ordering Party's representative about it and setting the basket in its original location within a period not longer than two working days;11) maintaining the baskets, i.e. performing current repair and maintenance of street baskets within the scope agreed with the Ordering Party's representative, in particular: a) systematic washing and cleaning of the baskets, especially during hot weather, b) current cleaning of the baskets from inscriptions, drawings, etc,c) disinfection of the dog excrement baskets every two weeks, at least, during the whole term of the contract,d) painting of the whole baskets in the area of the 1st time during the year after the end of the current winter season (April - May). The Contractor shall present the Contracting Authority with a protocol from the execution of these works,e) current, depending on the needs, painting of selected elements of the baskets,f) current, depending on the needs, straightening of bent elements and whole containers, within 24 hours from the moment of notification by the representative of the Contracting Authority or the Municipal Police of the City of Lublin,g) reinstallation of elements detached from the baskets, within 24 hours from the moment of notification by the
a representative of the Ordering Party or the Municipal Police of the City of Lublin, h) reinstallation of torn-out baskets, within 2 working days at the latest,
(i) repositioning of overturned concrete baskets within no more than 2 hours of notification
by the Contracting Authority, j) cleaning and painting at most once a year, cast iron elements in concrete baskets with
a cast iron ring, the Contractor shall present a report on the performance of these works to the Contracting Authority, k) cleaning, painting and filling in defects in the concrete casing, once a year at the latest in
concrete baskets with metal inserts, the Contractor will present the Contracting Authority with a report on the execution of these works, l) supplementing damaged or stolen metal inserts in concrete baskets (metal inserts
purchased by the Contractor), m) in the case of wooden baskets, painting, replacement and current filling of boards in the basket casing
and straightening, fastening and painting of metal parts, as well as cleaning and painting of entire baskets up to 2 times a year; 12. relocation (relocation) of existing metal baskets, their reassembly and assembly
new, owned by the Contractor, baskets with a capacity of 40 l - 50 l (waste baskets, dog excrement baskets) permanently connected to the ground within 3 working days from the date of written notification by the Ordering Party and indication of the new location of the basket; 13) the method of assembly of metal baskets in the ground should be performed in the following way: a) disassembly of the existing surface (paving stones, basalt cobblestone, concrete slabs, surface
a) construction of a trench for a post with minimum dimensions of 25 cm x 25 cm x 50 cm,
(c) placing the post with the anchoring element and the cover plate and then filling the hole with C8/10 concrete,
(d) plumbing of the post and concrete compaction,
(e) paving a demolished surface (as above) with sand filling of the joints in such a way that
the surface was under the grille (a fixed part of the mower - if any) or the restoration of the lawn surface. New metal baskets purchased by the Contractor should meet the following conditions:
- cylindrical container 35 cm - 40 cm and capacity 40l - 50l,
- mounting of the container on a single post, with a grille and anchoring element - length of the whole post
it should be 165 cm to 180 cm, of which the height of the post above the ground surface should be 120 cm to 130 cm and its length
mounted in the ground should be 45 cm - 50 cm, - the container should be fixed to a post at such a height that the top of the post is at
the height of 90 cm - 100 cm from the ground, - the basket should have a canopy fixed to the post at such a height that the distance of the canopy from the top
part of the container was 13 cm -17 cm, the diameter of the canopy should be equal to the diameter of the container, it is allowed to have the diameter of the canopy 5 cm larger than the diameter of the container, on the surface of the canopy there should be an ashtray (or ashtray), - the waste basket should be made of galvanized steel sheet according to PN-EN 10346:2011 standard,
the width of the whole waste basket should not exceed 50 cm, - the waste basket should be painted with powder paint;14) change of location (relocation) of concrete baskets within 3 working days from the written date
the Orderer shall report and indicate the new location of the basket. Change of location (relocation - disassembly/assembly) of metal baskets existing in the field, their reassembly, as well as assembly of new, owned by the Contractor baskets with a capacity of 40l - 50 l (metal baskets, dog excrement baskets) permanently connected to the ground within 3 working days from the date of written notification by the Ordering Party and his indication of the new location of the basket; 15) by phone or electronically (in the form of an e-mail), current information of the Ordering Party's representative about
observed damage to maintained waste baskets and dog waste baskets; 16) once a year, provide the Contracting Authority with information on the number of street waste baskets, dog waste baskets
droppings and metal inserts to concrete baskets currently stored by the Contractor and the amount of inserts used for replenishment in the field, indicating their location; 17) acceptance for maintenance and inclusion in the emptying schedule of new street waste baskets and
baskets for dog excrement, purchased by the Contractor on a separate order of the Contracting Authority; 18) in the case of introducing for maintenance and emptying new street waste baskets or baskets for
Dog income purchased by the Contractor on separate order of the Ordering Party, the Contractor shall enter it into a detailed emptying schedule and submit it to the Ordering Party's representative for approval within 1 day from the date of written notification;19) in the case of a change in the frequency of emptying of street waste baskets and dog excrement baskets,
reduction of their number or relocation, etc. The Contractor shall enter them into a detailed emptying schedule and submit them for approval to the Orderer's representative within 3 working days from the date of written notification; 20) The Orderer reserves the right to order disinfection of street waste baskets and baskets for
dog faeces with a virucidal/bacterial product for the entire duration of the contract to the extent chosen by the dog. (2) pursuant to art. 29 sec. 3a of the PPL Act, the Awarding Entity requires that the following activities be performed
with the performance of works covered by the contract (concerning the so-called manual workers), the performance of which consists in performing work in the manner specified in Article 22 § 1) of the Act of 26 June 1974. - Labour Code (Journal of Laws of 2019, item 1040, as amended), were performed by persons employed by the Contractor under an employment contract, in particular: a) driving a car with a total weight of up to 3.5 tons with a lockable chamber for temporary storage and
transport of waste, preventing pollination of the environment and ensuring transport of waste in accordance with the requirements of the applicable law; b) maintenance, emptying and placing street baskets for waste (including baskets for dog excrement). This obligation also applies to Subcontractors - the Contractor is obliged to include in each
the sub-contracting agreement, relevant provisions obliging Subcontractors to employ all persons performing the above mentioned activities under the employment contract. Detailed rules of documenting the employment of the above mentioned persons on the basis of the employment contract and the control of this obligation by the Ordering Party and sanctions provided for in this respect are specified in the model contract. The Contractor or Subcontractor shall employ these persons for the period necessary to perform the aforementioned activities; in case of termination of employment by the employee or employer before the end of this period, the Contractor shall be obliged to employ another person for this place. The above requirement does not apply to activities performed by a person(s) running a sole proprietorship. The activities of supervision over the performance of the works in question carried out by the Contractor's personnel shall not be subject to the pain of employment under the employment contract. 1. The scope of the contract covers the maintenance, emptying, placing, purchase and assembly of street waste baskets (including the baskets for dog excrement) in the area no. II in the road lanes within the area of the city of Lublin, which consists of:1) purchase, assembly, maintenance and emptying of street waste baskets, dog excrement baskets set up in road lanes; 2) carrying out the emptying of waste baskets and dog excrement baskets in a manner that does not cause contamination of surrounding lawns, roadways, sidewalks and other elements of road lanes, using appropriate vehicles, i.e. vehicles with a lockable chamber for temporary collection and transport of waste, preventing the pollination of the environment, and at the same time allowing the transport of waste in accordance with the requirements of the applicable law;3) collecting or sweeping and collecting waste collected next to the waste bin or the dog excrement bin, including cleaning the area within a radius of 5 meters from the bin, by sweeping the pavement, roadway, platform or cleaning the lawn. If there is a part of a city bench within a radius of 5 meters from the waste or dog excrement bin, the cleaning covers the entire area within the bench;4) providing plastic bags for street waste baskets and dog excrement baskets, each time these baskets are emptied;5) emptying of street baskets and dog excrement baskets in the intervention mode, i.e. 5) emptying street baskets and dog excrement baskets in an emergency mode, i.e. within 2 hours of being notified by a representative of the Ordering Party or the Municipal Police of the City of Lublin, if necessary, and notifying the Ordering Party by phone or e-mail about the work performed;6) installation of new waste baskets in places indicated by the Awarding Entity, purchased by the Contractor, and disassembly of currently used baskets and their reassembly in another location in the road lanes indicated by the Awarding Entity or taking them for storage in the warehouse within three days of the date of written notification by the Awarding Entity; 7) placing, during open-air events or other events, at the Awarding Entity's request, in places indicated by the Awarding Entity in the road lanes, of aesthetic street baskets (i.e. the baskets are placed on the premises of the Lublin City Council or the Lublin City Guard, if necessary, and notifying the Awarding Entity by phone or e-mail about the work performed; 8) placing, during open-air events or other events, at the Awarding Entity's request, in places indicated by the Awarding Entity in the road lanes, of aesthetic street baskets (i.e. the baskets are placed on the premises of the Lublin City Council or the Lublin City Guard. 7) to deliver baskets during open-air events or other events at the order of the Orderer, in places indicated by the Orderer in the road lane, aesthetic street baskets (i.e. in good sanitary and technical condition), owned by the Contractor, within 3 working days from the date of the written order by the Orderer and to empty them at the date indicated in the order, with the frequency indicated by the Orderer;8) to complete the missing elements of the baskets (e.g. stolen, devastated, etc.) within 24 hours from the moment of notification by the Orderer's representative;9) to remove them at the request of the Orderer, the City Guard of Lublin, etc. 9) removing, at the request of the Ordering Party, the Municipal Guard of the City of Lublin, etc., or observing the Contractor's own observations, the remains of destroyed baskets and baskets which are not suitable for repair and further use;10) in the case of finding that the basket has been moved by third parties to another place, informing the Ordering Party's representative about it and setting the basket in its original location within a period not longer than two working days;11) maintaining the baskets, i.e. performing current repair and maintenance of street baskets within the scope agreed with the Ordering Party's representative, in particular: a) systematic washing and cleaning of the baskets, especially during hot weather, b) current cleaning of the baskets from inscriptions, drawings, etc,c) disinfecting of the dog excrement baskets every two weeks during the whole contract period, d) painting of the whole baskets in the area of the second time during the year after the current winter season (April - May). The Contractor shall present the Contracting Authority with a protocol from the performance of these works,e) current, depending on the needs, painting of selected elements of the baskets,f) current, depending on the needs, straightening of bent elements and whole containers, within 24 hours from the moment of notification by a representative of the Contracting Authority or the Municipal Police of the City of Lublin,g) reinstallation of elements torn from the baskets, within 24 hours from the moment of notification by a representative of the Contracting Authority or the Municipal Police of the City of Lublin, h) reinstallation of torn-out baskets, within a period not longer than 2 working days,
(i) repositioning of overturned concrete baskets within no more than 2 hours of notification

The obligation also applies to Subcontractors - the Contractor is obliged to include in each subcontracting agreement appropriate provisions obliging Subcontractors to employ all persons performing the aforementioned activities. Detailed rules for documenting the employment of the above mentioned persons on the basis of the employment contract, as well as control of this obligation by the Ordering Party and sanctions provided for in this respect are specified in the model contract.
