Description

The objective of the procurement project in question is to award a framework agreement on the provision of bicycles by way of leasing through deferred compensation for the employees of various municipalities and a public law institution in the district of Leer for a term of six years between the clients as lessees on the one hand and a competent and efficient service provider together with a lessor as financing partner on the other. Both the service provider and the lessor jointly become contractors under the framework agreement. The framework agreement regulates the basic service relationships between the principals and the contractor and contains the essential requirements for the individual leasing contracts as well as for the transfer and fee conversion contracts for use by the employees. The individual leasing contracts and the transfer and fee conversion contracts are concluded separately.
The customers are various municipalities and towns belonging to the district as well as a public law institution in the district of Leer in Lower Saxony with a total population of around 135,000. As local authorities within the meaning of § 2 (2) of the Lower Saxony Local Government Constitution Act (Niedersächsisches Kommunalverfassungsgesetz - NKomVG), the clients are municipal employers and belong to the Kommunaler Arbeitgeberverband Niedersachsen e.V. (Lower Saxony Municipal Employers' Association), so that the total of around 1,600 employees of the clients are subject to the collective agreement for the public sector ("TVöD"). This was supplemented with effect from March 1, 2021 by the collective agreement on deferred compensation for the purpose of leasing bicycles in the municipal public service dated October 25, 2020 ("TV-Fahrradleasing"). Against this background, the contracting authorities intend to implement the TV-Fahrradleasing, which enables them to lease bicycles, e-bikes and cargo bikes within the meaning of Section 63a of the German Road Traffic Licensing Regulations (StVZO) ("bicycles") as well as accessories that can be leased in accordance with the TV-Fahrradleasing from a company and to make them available to employees for use.The object of the procurement project is the award of a framework agreement between the clients as lessees on the one hand and a competent and efficient service provider together with a lessor as financing partner on the other hand, on the basis of which individual leasing contracts can be concluded for the provision of bicycles together with accessories for the employees of the clients. The main services include (1) introduction of the framework agreement into the administrative structures of the customers, in particular through the availability of a (deputy) project manager and training of the personnel managers at the customers; (2) implementation of the framework agreement and handling of the procedure for the provision of the bicycle through the operation of an online platform and through the availability of contact persons for the persons responsible at the customers, e.g. for questions regarding individual leasing contracts; (3) provision of bicycles and leasable accessories (e.g. bicycle lock, light, pedals, etc.) at the choice of the employee on the basis of a contract concluded with the lessor.) at the employee's option on the basis of an individual leasing contract between a client as lessee and the contractor as lessor;(4) marketing of bicycle leasing to employees;(5) provision of insurance benefits for defined insured events and handling of incident management; and (6) services for employees, such as annual maintenance and inspections. The contracting authorities intend to conclude the framework agreement as a basis for the provision of services for a term of six years. It is assumed that a maximum of 1,600 individual leasing contracts will be concluded over the entire term of the framework agreement.
