Description

The NRW State Office for Nature, Environment and Consumer Protection (LANUV) intends to conclude a framework agreement per lot for the sampling (lot 1) and analysis (lot 2) of approx. 270 fuel samples per calendar year in NRW for a period of four years. The framework agreement is to be used in particular by the competent lower immission control authorities, the details of which are set out in the terms of reference.
In the state of North Rhine-Westphalia, approx. 270 samples are ordered per calendar year, which are distributed among all the lower immission control authorities. Sampling of winter products is carried out in the period from 01.01. to 28.02. and from 16.11. to 31.12. Sampling of summer goods is to be carried out in the period from 15 April to 30 September. The number and the locations of the samples to be taken result from a list of the filling stations, which is specified or newly drawn up annually by the lower immission control authorities. According to Annex 20, I and II of the General Administrative Regulation for the Implementation of the 10th BImSchV of 4 September 2012 (BAnz. AT 10.09.2012 B2), the samples are distributed among the fuels as follows:- approx. 86 samples of petrol E5 (normal, super)- approx. 78 samples of diesel fuel- approx. 86 samples of petrol E10- In addition, approx. 6 samples of petrol "Super Plus sulphur-free RON 98" and- a further approx. 14 samples of other fuels (ethanol fuel (E85), liquefied petroleum gas, natural gas/biogas as fuel, biodiesel, vegetable oil fuel) with a market share of less than 10 %The samples are to be taken in equal parts in the summer and winter periods as far as possible.The distribution of the samples between petrol, diesel and other fuels can be adjusted by the client or the body issuing the invitation to tender. The number of samples to be taken can deviate upwards or downwards by approx. 10%. The petrol stations to be sampled are specified by the NRW State Office for Nature, Environment and Consumer Protection (LANUV) in consultation with the lower immission control authorities by 31 March of each year. The fuel samples are to be taken at the filling station as an outlet sample from the nozzle without prior notification to the person responsible for the award (exception: exclusive card filling stations). The respective lower immission control authority must be informed by e-mail at least one week in advance so that it can participate. The following standards and special requirements must be observed when taking and transporting the samples:- petrol and diesel fuels, as well as biodiesel, ethanol fuel (E85) and vegetable oil fuel in accordance with DIN EN 14275, December 2003 edition. A four-litre pre-run can only be dispensed with if the sample is taken directly after a refuelling process. The liquid fuel samples are to be filled in three gas-tight sealable containers of approximately four litres each, with a filling level in accordance with the respective applicable standard.- Liquid gas fuel in accordance with DIN 51610, June 1983 edition. In the case of liquid gas fuel, smaller sample quantities are sufficient in accordance with DIN 51610.- In the case of natural gas as fuel, the sample is to be taken at the nozzle via an adapter piece in accordance with DVGW worksheet G 264. At least two aluminium pressure gas cylinders with a volume of 2 litres are filled to a final pressure of 150 bar. For safety reasons, it should not be necessary to take a reserve sample, i.e. no pressurised gas cylinder must remain with the respondent at the filling station, as safe storage and handling may not always be guaranteed. In this case, in the event of a dispute, a sufficient quantity of the analysis sample shall be made available to the respondent for further analysis. The fuel samples taken shall be secured by sealing or other equivalent measures. The responsible service station personnel shall confirm that the fuel sample remaining there (referee sample) remains unchanged and that the place and time of sampling can be proven at any time. Of the three containers (two each for natural gas and LPG) per sampling, the first serves as an analysis sample and the second container as a reserve sample, which remains with the Contractor for at least one year for the analytical examination (lot 2). The third container, except for natural gas and liquefied petroleum gas, shall also remain at the respondent's premises for at least one year as an arbitration sample. The sampling, the handling of the samples and the storage of the samples shall be carried out in accordance with the relevant occupational health and safety as well as safety and environmental protection regulations. The fuel sampling is to be planned efficiently by the contractor, in particular, sampling locations close to each other are to be completed with one journey. For the subsequent analysis, the samples are to be sent to the commissioned laboratory (lot 2) within one week. The protocol on the sampling of fuels shall be carried out in accordance with Annex 1 of the General Administrative Regulation on the Implementation of the 10th BImSchV of 04 September 2012 (BAnz. AT 10.09.2012 B2) In the Land of North Rhine-Westphalia, approx. 270 samples are arranged per calendar year, which are distributed among all Lower Immission Control Authorities. The samples for the analysis orders of the winter goods are taken in the period from 01.01. to 28.02. and from 16.11. to 31.12. respectively. The samples of the summer goods are taken in the period from 15.04. to 30.09. The samples are distributed according to Annex 20, I and II of the General Administrative Regulation for the Implementation of the 10th BImSchV of 04 September 2012 (BAnz. AT 10.09.2012 B2) to the fuels as follows:- approx. 86 samples of petrol E5 (Normal, Super)- approx. 78 samples of diesel fuel- approx. 86 samples of petrol E10- Additionally approx. 6 samples of petrol "Super Plus sulphur-free RON 98" and- further approx. 14 samples of other fuels (ethanol fuel (E85), liquefied petroleum gas, natural gas/biogas as fuel, biodiesel, vegetable oil fuel) with a market share of less than 10 %The allocation of the samples to petrol, diesel or other fuels can be adjusted by the client or the body issuing the invitation to tender. The number of samples to be analysed may vary by approx. 10% upwards or downwards.The first of the three containers (two each for natural gas and liquefied petroleum gas) per sampling serves as the analysis sample.The handling and storage of the samples must be carried out in accordance with the relevant occupational health and safety and environmental protection regulations.The subsequent analysis of the samples must be completed after four weeks at the latest and the results must be forwarded to the LANUV and, in parallel, to the Lower Immission Protection Authorities. The contact persons at the Lower Immission Control Authorities will be announced after the award of the contract. All substances listed in Annexes 3 and 4 (petrol E5), 5 (petrol E10), 6 (diesel fuel), 7 (biodiesel), 8 (ethanol fuel E85), 9 (liquid gas), 10 (natural gas and biogas) and 11 (vegetable oil fuel) of the General Administrative Regulation for the Implementation of the 10. BImSchV of 4 September 2012 (BAnz. AT 10.09.2012 B2) on the basis of the test procedures specified therein.The documentation of the analysis results shall be carried out electronically by means of the Excel tables of the BMU [Template-Sommerperiode.xls and Template-Winterperiode.xls] made available upon request. The test results shall be compared with the rejection limit values specified in Annexes 3, 4, 5, 6, 7, 8, 9, 10 and 11 of the General Administrative Regulation on the Implementation of the 10th BImSchV of 04 September 2012 (BAnz. AT 10.09.2012 B2). Test results exceeding or falling below the rejection limit values shall be highlighted in red as background in the Excel table and immediately transmitted electronically to the LANUV and the competent lower immission control authority.
